Ware to W. S. & J. A. Mudd This Indenture, Made and entered into this 26th day of October A.D. 1850 between Zadoc Ware and Eleanor D. Ware his wife of the first [part], and William S. Mudd and James A. Mudd of the second part Witnesseth: That whereas James Mudd late of the County of Jefferson did on the 2nd day of January 1846, make and publish his last will and testament and did therein bequeath as follows to wit: “Item III I give and bequeath unto my sons William S. Mudd and James A. Mudd out of the money arrising [sic] from the sale of my property the sum of Two Thousand dollars, to have and to hold and so to manage the same as to them shall seem best to and for the sole seperate [sic] and exclusive use benefit and support of my daughter Susan C. Dupuy and her children which she now has or may hereafter have, the same not to be liable in any way for the payment of any debt or debts which Stephen H. Dupuy the husband of the said Susan S. may now owe or hereafter contract nor to be liable in any way to be used, controlled or managed by the said Stephen H. Dupuy. And I do hereby fully authorize and empower the said William S. Mudd and James A. Mudd at any time when they may think best to convert the said Two Thousand dollars above mentioned, or any part thereof, into either real or personal property or both and when so converted to have and to hold the same and so to manage the rents and profits and increase thereof so as to secure them to and for and for [repeated] the sole seperate[sic] and exclusive use, benefit and support of my daughter Susan S. Dupuy and her children which she now has or may hereafter have, the same not to be in any way liable for any debt or debts which her husband Stephen H. Dupuy may now owe or hereafter contract, nor subject to be sold, controlled or managed in any way by the said Stephen H. Dupuy. And if the said Susan S. Dupuy shall die leaving children surviving her, then it is my will that this legacy or so much thereof as may then remain shall be equally divided between said children, and if the said Susan S. Dupuy shall die leaving no child or children surviving her, then it is my will that this legacy or so much thereof as may then remain shall be equally divided between my legal heirs. And whereas the said William S. Mudd and James A. Mudd acting under the power and authority vested in them (a strikethrough) by the above item of said Will have purchased of and from the said Zadoc Ware & Eleanor D. Ware his wife the tracts or parcels of land hereinafter described at and for the sum of One Thousand. Now therefore be it known that the said Zadoc Ware and Eleanor D. Ware his wife for and in consideration of the said sum of One Thousand dollars to them in hand paid, the receipt whereof is hereby acknowledged, have this day bargained sold and conveyed and doth by these presents bargain sell and convey unto the said William S. Mudd and James A. Mudd the following described tracts or parcels of land situate in the County of Jefferson in the State of Alabama, to wit, the West half of the North West quarter of Section nineteen in Township eighteen Range 3 West & The E ½ of the N.W ¼ of same Section Township and Range. To have and to hold to the said William S. Mudd and James A. Mudd the said above described tracts or parcels of land subject to the trusts and provisions of the Will of James Mudd deceased as herein above set forth. And the said parties of the first part for themselves their heirs executors and administrators do and by these presents will forever warrant and defend the title of said lands unto the said parties of the second part from the legal claim or claims of themselves and their heirs and assigns and from all and every person or persons whomsoever. Ware his wife who acknowledged that they signed sealed and delivered the foregoing deed on the day and year therein mentioned to the aforesaid William S. Mudd and James A. Her sister Nancy McLure was married to a Robert Owen - this may have been him as acting Justice of the Peace.
