I moved to Ensley last year. I have been living in the State of Alabama for fourteen years. I am thirty years old. Andrew Marshall is my husband. I was married to him the 27th of May ten years ago. I lived with him five years, and we have been apart for five years. He abandoned me five years ago and has never been back to me. He lives here in Birmingham now on 14th St. and 3rd Alley. Since he abandoned me, he has not contributed any to my support. We have never lived together since. While we lived together, I was a good wife to him. He left me on account of another woman that he took up with. [signed Ada Marshall] Testimony of Laura Smith: My name is Laura Smith. I live down by the Car Barn in Birmingham. I was born the first year the War started. At the time of the Surrender I belonged to Herbert Stevens and lived on his place. I 'member when the Yankees passed through our place. They didn't steal so much but they sho tore down the corn and cotton. I was still there when the War ceas-ted. I know Ada and Andrew Marshall the parties of this suit. I married Ada's uncle. I have know Ada since she was a little gal. I know when they were married. They married about seven years ago. They have been parted five or six years. He left her of a sudden. He took his trunk away. I don't know why he left. I was often around their house when they lived together. She worked and kept his house in good shape. She came to my house crying and said that he had taken his trunk and left her. There was some talk of his having taken up with another woman, but I can't say positive as to that. I don't know where he is now. X Laura Smith, her mark Witness: Morsheimer Testimony of Fannie Christian: I am fifty five years old. I live at Graymont, and have lived there six or seven years now. She was married to Andrew when I got acquainted with them. They have been parted about five years this month I know that because that was about the time my daughter died. They were both in the same Lodge with me. I was around their house often. She was dutiful and kept a nice home. I think he left her on account of another woman. She told me about a letter she found in the house, a letter from another woman to him. She was crying when she told me about it. He left her and has never been back to her. He took his trunk with him when he went away.
