In the name of God, I, George Nash of the County of Lounds and State of Mississippi aged seventy seven years. Knowing that it is appointed unto all men once to die but the uncertainty of the time thereof my advanced age and past afflictions admonish me that whilst I am in the enjoyment of a sound mind and disposing memory it is prudent that I should now make such discretion of my property for the benefit of my creditors, children and grandchildren which I have been enabled to acquire by means of industry and economy under the blessings of a kind providence for whose abiding care and favour I trust I feel a becoming humility and gratitude I do therefore make publish and declare the following to be my last will and Testament. In the first place I desire and direct my executors to pay all my just debts that may remain unpaid at the time of my death and for which provisions will be made as hereinafter directed. 2nd. It is my will and desire that my son Milton shall keep in his possession my plantation negroes now in possession, horses, mules & oxen, stock, farming tools and utensils until the close of the year 1850 and that the net proceeds of the plantation shall be applied as soon as can be, also my present crop to payment of all my just debts and my son Milton must retain out of the present crop of this year a sufficient supply to support himself and family and the negroes , horses and stock for the year 1850 without intending in any way to alter the contract now existing between us for his personal services for Superintending my business, uniting his force with mine in making the crop. 3rd To my son John Nash I will and bequeath my negro man Andrew together with the property which I have heretofore given to him upon the condition however that he shall pay to my son Jesse C. Nash three hundred dollars when he takes Andrew into his possession according the the intent and meaning of the conditions of my will. 4th To my three grandchildren, Elizabeth, Isabella and Martha, daughters of my son Cooper B. Nash, I will and bequeath my negro man Allen and his wife Fanny with their increase if any there should be to them their heirs and assigns forever. 5th To my son Milton Nash I give and bequeath my negro man Washington together with the property I have given him heretofore. 6th To my son Jesse G. Nash I give and bequeath eight hundred dollars in money in addition to the sum of three hundred dollars which I have required my son John to pay to him as soon as the money can be conveniently realized from the sale of my land and other property not specifically devised in this will to my other children and grandchildren. 7th To my son in law Warren Truss and his wife Polly I give and bequeath my negro boy Ruffin and two hundred dollars in money when it can be raised from my estate as pointed out for the payment of eight hundred dollars to my son Jesse G. Nash. 8th To my son in law DAVID HANBY and my daughter Margaret Hanby I will and bequeath negro boy Joe and one hundred dollars to be raised as is provided for in the 6th and 7th items. 9th To my son in law Arthur Truss and my daugher Mahala Truss I will and bequeath my negro girl Parthena and the property heretofore given them 10th To my four grandchildren, Julia Ann, Elizabeth, Martha and George Ayers children of John B. Ayers and Sally Ayers I give and bequeath one hundred dollars to be paid to each of them when realized out of my estate as is provided for my son Jesse G. Nash and others above mentioned that is to say I will and bequeath to those four children four hundred dollars to them and their heirs and assigns forever. 11th To my grandchildren Robert, George Mansfield, Elizabeth and Amanda Hagood, Children of Zachariah Hagood and my daughter Nancy, now deceased, I will and bequeath one hundred dollars each to be paid to them out of my estate as is provided for my son Jesse G. and others. 12th It is my will and desire and I hereby direct my Executors to place my faithful and trusty old woman Matilda in a comfortable home with some of my children having in view Justice to all my children and grandchildren above provided for as well as kind treatment and reasonable indulgence to this faithful servant of the family and it is my particular injunction upon whosoever the care of this servant may fall to take good care of her in sickness and in health knowing well that so long as she has health and strength she will not be a burden to any one. 13th It is my will and desire that all my estate both real and personal which has not been disposed of and given in this will to my children and grandchildren shall be sold on a credit of one or two years or even longer time if my executors shall consider it advisable requiring in all cases from the purchases notes with good security for the purchase money and after first paying my just debts if the present crop and crop of next year will not pay all my debts then the residue after paying the expenses of carrying out my will and the administration thereof, and one hundred dollars for enclosing their mother's grave, shall be equally divided amongst my children, John, Milton, Jesse G., Polly Truss, and Margaret Hanby to them their heirs forever. I have already given to my son Cooper B. Nash and to my son in law John B. Ayers and Zachariah Hagood that portion of my estate which I intend for them, and therefore no provision is made for them in this will. Lastly I nominate and appoint my sons Milton Nash and Jesse G. Nash Executors of this my last Will and Testament hereby revoking and declaring null and void all other wills by me heretofore made. In testimony whereof I have hereunto set my hand and affixed my seal this fifth day of October in the year of our Lord one thousand eight hundred and forty-nine the word keep between heirs 15 and 16 enterlined before signed. Personally appeared in open court one of the subscribing witnesses to the paper writing herto annext purporting to be the last will and testament of George Nash lat of said county dec'd who being duly sworn deposeth and saith that he saw the said George Nash sign the said paper writing as his last will and testament on the day and year therein mentioned and that he this deponant subscribed his name as a witness thereto in the presenced of the said George Nash.
