ALGenWeb File Manager - Carolyn Golowka -------------------------------------------------------------------------- Submitted by Tricia Kuner-Smith, tricia10@peoplepc.com November 2000 1885 Mortgage from David & Sophronia Moore to John Webb Lamar Co, AL Deek Book 9 Page 489 4 April 1885 State of AL Lamar Co Know all men by these presents that we DAVID MOORE and his wife SOPHRONIA MOORE for and in consideration that we are indebted to JOHN WEBB in the sum of twenty seven $27 dollars which is evidenced by our promissary note bearing even date with this instrument and payable to said JOHN WEBB on the first day of December 1885 and in order to secure the payment of said note when the same falls due so that no default be made in the payment thereof we do hereby seel, transfer, and convey unto the said JOHN WEBB the following tract of land to wit NW 1/4 of sec 9 and the SW 1/4 of section 4 except 10 acres off the west side all in Township 15, Range 16 west to have and to hold unto the said JOHN WEBB, his heirs, and assigns forever upon condition that if we pay said note above described on or before said 1st day of December 1885 when the same falls due then this conveyance is to be void but if we fail to pay the note at it's maturity in part or in full then the said JOHN WEBB or his lawful representative is hereby authorized to take possession of said land above described and after giving 30 days notice of time and terms and place of sale of sale (sic) by posting at the courthouse and two other public places to sell the same to the highest bidder for cash at the residence of said JOHN WEBB and make titles to the purchaser and to devote the proceeds of the sale to the payment 1st of the expenses of this tract and advertising, selling, and conveying, 2nd of the amount that may be due on said note, and if a surplus remain the same is to be returned to the undersigned.
