Berryman & wife, Elizabeth to Willis B. Beaver - Lawrence Co., AL This indenture made and entered into this 3rd day of September 1855 between A. A. Berry and his wife Elizabeth, both of the County of Lawrence and State of Alabama of the one part and Willis B. Beaver of the County of Fayette and State of Tennessee, witnesseth. That the said Berry and wife for and in consideration of the sum of sixty five dollars to them in hand paid by the said W. B. Beaver, the receipt whereof is hereby acknowledged, hath given, granted, bargained and sold and by these presents doth give, grant, bargain and sell unto the said Willis B. Beaver his heirs and assigns all their individual interest, being the fourteenth part thereof in and to a tract of land in the said County of Fayette and State of Tennessee Containing by estimation two hundred and thirty five and one fourth acres, more or less, being the same tract of land owned by Michael Beaver dec'd at the time of his death, and on which he resided at that time, lying about one mile South East of the Town of Concordia in said Fayette County and being all the land owned by Michael Beaver in said County at the time of his death, and which said undivided interest descended to said Elizabeth Berry as one of the heirs at law of said Michael Beavers dec'd. To have and to hold the same to the said Willis B. Beaver his heirs and assigns forever, and we do covenant and bind ourselves our heirs and representatives to warrant and forever defend the title to said interest to said Beaver his heirs and assigns against the lawful claims of all persons whatsoever. And if there has already been a petition filed in the Chancery Court at Somerville by the heirs of said Michael Beaver dec'd to sell said land then we do hereby authorize and empower the said Willis B. Beaver to receive and take over our portion of the funds arising from such sale, instead of the land itself and his receipt to the person having or that may hereafter have said funds in hand shall be a full and complete discharge of the to such person for the same. And the said Beaver is hereby authorized and empowered to do any other act or thing in reference thereto that we ourselves could do, were we personally present and acting for ourselves. And we do hereby ratify and confirm all the lawful actings and doing of our said attorney in the premises. Given under our hands and seals the day and date fixed above written. A. A. Berry and Elizabeth Berry, whose names are signed on the foregoing conveyance, and who is known to me, acknowledged before me, on this day, that being informed of the contents of the conveyance they signed the same voluntarily, on the day the same bears date.
