[More legible copy in Harvey family file] Articles of a marriage contract made and entered into this 23rd of Dec 1828. Between John Harvey of the county of Lawrence and State of Alabama of the one part and Ann Harper of the aforsd county and state of the other part. Witnesseth that whereas the parties are about to be married and and whereas each has children of their own by former marriages and are both desirous that each ones property shall finally go to each ones own children as tho they had never been married and that the title of the property of either shall not be allotted or changed by the marriage the parties have covenanted and agreed as follows: to wit. The said Harvey on his part & as do agree all legal title which he would otherwise derive to the property of the said Mrs. Harper by their intermarry, further than the peaceable possession use and profits of it during their married state at her death he relinquishes all title and agrees that he will immediately thereafter (should he be the longest liver) deliver over to her legal heirs the property which she may have brought with her to his house with the increase of negroes if any except what may be lost by wear, accident, death ____ and the sd Mrs. Harper on her part covenants and agrees that she will join her property to the sd Harvey's meshing one common stock to continue such until one or the other dies. But it is understood and agreed upon between the parties that the sd Mrs. Harper reserves to herself the privilege if she should ever think proper, at any time to divide the one half of her property among her own children and the sd Mrs. Harper in consideration of the waive which the sd Harvey has made to any legal title which the marriage would give him to her property that she will on her part waive all title or claim which she may have by marriage to dower in his estate, and both hereby agree to take at the death of the said Harvey her own property relinquishes all right of dower on his estate except as follows to wit. It is the understanding of the parties that should the sd Mrs. Harper be the longest liver, she is to continue at the residence of the sd Harvey occupying it as her home during her natural life, or as long as she may think fit to continue on it and it is furthermore understood and agreed upon between the parties that the debts heretofore contracted is to be paid out of the estate of the party by whom it was contracted and that the debts of either one is not to be paid out of the property of the other.
