R V G page 658; 23 S.W. 1/4 S. 26, T. 6 R 7 Deposited and Recorded Jan. 10th, 1838; Proof Recording....$1.50 This indenture made and entered into this 9th day of January 1838 beteween Lancaster C. McVay of the one part, and Javan McVay and Hugh McVay in behalf of the heirs of the said Javan & Hugh McVay fo the other part witnesseth that for and in consideration of the natural love and affection which I have and bear unto the children now in being of my said brothers Javan & Hugh McVay, as well as to contribute to a more equal distribution of the real estate of our common father John McVay and for the sum of one dollar to me in hand paid by the said Hugh & Javan McVay I have this day given, granted, bargained and sold and by these presents to give, grant, bargain sell and convey unto the said Javan & Hugh McVay and the heirs of their bodies in being at the time of their death, & the children of such as my have died during the lifetime of Javan & Hugh McVay two equal undivided thirds of the South West quarter of section 26, in Township 6 Range 7 West, situated, lying, and being in the County of Lawrence and State of Alabama to have ans to hold the above described parcel of land to them, the said Javan & Hugh McVay and their heirs of their bodies in being at the time of their death and the children of such as may have died during the lifetime of said Javan & Hugh McVay, forever, and the said Lancaster C. McVay for himself his heirs exectors and administrators covenants to and with the said parties of defend the title to said lands above conveyed against all claims whatsoever.in testimony whereof I have hereunto set my hand and affixed my seal this day & year as above written. McVay who name is signed to the within and foregoing Deed who acknowledge that he signed, sealed and delivered the said deed to the said Javan McVay & Hugh McVay on the day of the date thereof and for the purpose therein set-forth. In Testimony whereof I hereunto set my name at Office on the 10th day of January, 1838.
