McKinnon of the county of Lee and State of Alabama considering the uncertainty of this life, and being of Sound mind and memory do make declare and publish this my last will and testament. First, I give and bequeath unto my beloved wife, Mary, the use improvement and income of my dwelling house and plantation on which I now reside containing one hundred & Sixty acres of land it being the east half of the south east quarter of section nine and the South half of the north east quarter of Section nine in Township Seventeen of range twenty Seven originally Russell now Lee county Alabama with all the corn fodder(?) meat and stock of hogs cattle mules and horses with all the farming utensils on the place as also the household and kitchen furniture also the present crop of cotton on hand and unsold, to have and to hold the same to her for and during her natural life or widowhood. Second I give and bequeath to my daughter Catherine Heywood Ten dollars to be paid to her by my executors herein after named within Six months after my deceas. Third I give and bequeath to my son George W McKinnon Eighty acres of land it being known as the North half of the North east quarter of Section nine Township Seventeen and range twenty seven County of Lee and state of Alabama. Fourth I give and bequeath to my daughter Mary Fuller eighty acres of land it being known as the North west quarter of the South west quarter and the South west quarter of the North west quarter of Section ten Township Seventeen of Range twenty Seven Lee county Alabama. Fifth I give and bequeath to my son John W McKinnon, George W McKinnon and my daughter Mary Fuller all of the residual of my estate real personal or mixed of which I shall die __ and __ or to which I shall be entitled at the time of my deceas and I also give devise and bequeath to my said son John W McKinnon George W McKinnon and my daughter Mary Fuller the revision or remainder of my house and land and their appointments now on which I reside and all profit income and advantage that may result therefrom to be equally divided between them from and after the deceased of my beloved wife Mary. Sixth I do nominate and appoint my wife Mary and my son George W McKinnon to be the executors of this my last Will and testament. In testimony I have to this my last will and testament Subscribe my name and affixed my Seal to this the 26th day of January 1867. John L. McKinnon deceased Before me David Read, Judge of the Said Court personally appeared in open court Daniel Bullard and L B Mays who having been by me first respectively duly Sworn and examined did and do depose and Say on oath that they are each Subscribing Witnesses to the instrument of writing now shown to them and which purports to be the last will and testament of John L. McKinnon deceased late on inhabitant of this county; that Said John L. McKinnon Since deceased Signed and executed Said instrument on the day the same believed date and declare the Same to be his last will and testament and that affiiants set their Signatures thereto on the day the Same believed date; as Subscribing Witnesses to the same in the presence of the said testator; That Said Testator was of sound mind and disposing memory; and in the opinion of Deponents fully capable of making his will at the time of Same was so made as aforesaid. Affiants further State that the Said testator was on the day of the Said date of the said Will of the full age of Seventy one years and upwards."
