Horton ==================================================================== November 2002 Records of the Administration of the Estate of JAMES JACKSON PROBATE MINUTES, 1871-1875 Pages 533 - 535 Limestone County, Alabama DECEMBER TERM, 1873 AMANDA JACKSON, Ward } Decree in Partial Settlement} This being the day to which this cause has been regularly continued from the day set to hear and pass upon the account heretofore filed by RICHARD DALEY as the Guardian of said Ward for a partial settlement of his administration thereof. Now comes the said DALEY and moves the Court to proceed with such settlement & that said account be passed and allowed and also comes CHAS. M. HAYES who was heretofore on the filing of said account duly appointed Guardian ad litem for said Ward & who then in writing accepted said appointment; and it appearing to the Court from proper evidence that due notice of the time & nature of the settlement has been given by publication for three successive weeks in the “Limestone Herald”, a newspaper published in this County, the Court proceeds to audit & examine said accounts & vouchers whereby it appears that said Guardian has received and is chargeable with the sum of Thirty one & 44/100 Dollars and that he has legally & justly paid out for & in behalf of said Ward the sum of One hundred & ninety four & 65/100 Dollars which leaves a balance of One hundred & sixty three 21/100 Dollars due from said Ward to him. It is ordered, adjudged, & decreed that said accounts & vouchers so audited, examined, & stated be & the same are hereby in all things passed & allowed as the Partial Settlement of said RICHARD DALEY as Gdn as aforesaid & that the same be filed & recorded. Dec 11th, 1873 CLEMENTINE JACKSON, Ward } Decree in Partial Settlement} This being the day to which this cause has been regularly continued from the day set to hear and pass upon the account heretofore filed by RICHARD DALEY as the Guardian of said Ward for a Partial Settlement of his Guardianship thereof: Now comes the said DALEY and moves the Court to proceed with such settlement & that said account may be passed & allowed. It is ordered, adjudged, & decreed that said accounts & vouchers so audited, examined & stated by and the same are hereby in all things passed & allowed as the Partial Settlement of said RICHD DALEY as Guardian as aforesaid & that the same be filed & recorded. Dec 11th, 1873 ALEXANDER JACKSON, Ward } Decree in Final Judgement } This being the day to which this cause has been regularly continued from the day set to hear and pass upon the account heretofore filed by RICHARD DALEY as the Guardian of said Ward for a final settlement of his Guardianship. Now comes the said DALEY and moves the Court to proceed with such settlement & that said account may be passed & allowed. And it appearing to the Court from proper evidence that said Ward is of full age; that due notice of the time & nature of this settlement has been given by publication for three successive weeks in the “Limestone News”, a newspaper published in this County. The Court proceeds to audit & examine said accounts & vouchers whereby it appears that said Guardian has received and is chargeable with the sum of Thirty one & 44/100 Dollars and that he has legally & justly paid out for said Ward the sum of Two hundred & ninety 27/100 Dollars, leaving an amount of Two hundred fifty eight 83/100 Dollars due him from aid Ward. It is ordered, adjudged & decreed that said accounts & vouchers so audited, examined & stated be and the same are hereby in all things passed & allowed as the final settlement of said RICHD DALEY as Guardian as aforesaid & that the same be filed & recorded. Dec 11th, 1873 SAMUEL JACKSON, Ward } Decree in Final Judgement } This being the day to which this cause has been regularly continued from the day set to hear and pass upon the account heretofore filed by RICHARD DALEY as the Guardian of said Ward for a final settlement of his Guardianship. Now comes the said DALEY and moves the Court to proceed with such settlement & that said account may be passed & allowed. And it appearing to the Court from proper evidence that said Ward is of full age: that due notice of the time & nature of this settlement has been given by publication for three successive weeks in the “Limestone News”, a newspaper published in this County. It is ordered, adjudged & decreed that said account & voucher so audited, examined & stated be and the same are hereby in all things passed & allowed as the final settlement of said RICHD DALEY as Guardian as aforesaid & that the same be filed & recorded. Dec 11th, 1873 NANCY JACKSON, Now ROPER } Decree in Final Judgement } This being the day to which this cause has been regularly continued from the day set to hear & pass upon the account heretofore filed by RICHARD DALEY, the Guardian of said Ward, for a final settlement of his Guardianship. Now comes the said DALEY & moves the Court to proceed in final settlement & that said account may be passed & allowed: And it appearing to the Court from proper evidence that said Ward is of full age; that due notice of the time & nature of this settlement has been given by publication for three successive weeks in the “Limestone News”, a newspaper published in this County. The Court proceeds to audit said accounts & vouchers whereby it appears that said Guardian has received and is chargeable with the sum of Thirty one & 44/100 Dollars: that he has legally and justly paid out and expended for said Ward the sum of One hundred Seventy one Dollars, leaving an amount of One hundred Thirty eight & 56/100 Dollars* due him from said Ward. It is ordered, adjudged & decreed that said accounts & vouchers so audited, examined & stated be and the same are hereby in all things passed & allowed as the final settlement of said RICHD DALEY as Guardian as aforesaid & that the same be filed & recorded. Dec 11th, 1873 Note from Transcriber: *There appears to be an error in the above amounts for NANCY JACKSON ROPER’s account since $171.00 less the $31.44 already paid Mr. DALEY would leave a balance due him of $139.56.
