C. and AMANDA JACKSON vs. ALEX T JACKSON et als In the matter of the petition & application of said plaintiffs for the sale of certain real estate for partition and division This day comes JOSEPH A. MOORE, JOHN H. DAVIS, and GEO. W. TURNER, the Commissioners heretofore appointee by the Judge of the Court to sell certain real property which is particularly set forth and described in the decree of said Judge, entered in the previous on the 23rd day of July, 1873 and filed their report in writing & under oath showing this action and proceedings in the previous. And the said report having been examined by the Judge of the Court and no valid objection or exception thereto having been made or filed. It is ordered that the same be in all things approved, ratified, & confirmed: It is further ordered that said report of said Commissioners be recorded as a part of this decree and the said report being read is as follows: "The State of Alabama Limestone County. To Hon. JOSHUA P. "CONNAN, Judge of Probate of said County, The undersigned "Commissioners appointed by your Honor to sell the real estate "belonging jointly, equally and in common to RISPA ANN JACKSON, "AMANDA JACKSON, ALEXANDER JACKSON, SAMUEL "JACKSON and GEORGE W. JACKSON, assignee of NANCY "ROPER & her husband JACOB ROPER, report that in pursuance of an "order heretofore made by said Probate Court to wit, on the 23rd day of "July, 1873, authorizing and empowering the undersigned to sell the "realty belonging to said joint owners; after having given due & legal "notice by advertising the same in the "Limestone News", a public "newspaper published in the town of Athens, Limestone County, "Alabama, for the three succeeding weeks previous to the day of sale "setting forth the time, terms, and place of sale on Monday, the 15th day "of October, 1873, viz the day and at the place appointed for said sale "and between the legal hours of sale did offer said realty for sale at "public outing; and at said sale RICHARD H. DAILY being the "highest, best & last bidder therefor became the purchaser of said realty "divided as follows, viz: That portion of Section Seven Township One "Range (6) Six beginning north west of the north east beginning corner "running south to the corner of DALEY McDONALD land near one "fourth of a mile due east and one fourth and one hundred yards more "or less to the spring; then down the branch east to Section Five where "it crosses the line into Section Five, then down the said branch to the "creek, thence north up the creek to the corner of McDONALD & "JACKSON land. Thence west with the fence to the section line. "Thence south along section line to the corner, thence west with the "section line to the beginning corner, containing one hundred & thirty "acres, at the sum of Seven hundred & fifty dollars for the whole. The "said Commissioners further report that said RICHARD H. DAILY has "complied with the terms of said sale and has paid one half of the "purchase money and executed his bond with good & sufficient security "for the balance payable twelve months after the day of sale; that said "sale was fairly conducted and that said realty was sold for an amount "not unequal to its value. Wherefore, the said Commissioners pray that "said sale be satisfied and confirmed, all of which is respectfully submitted. JOSEPH A. MOORE} JOHN H. DAVIS } Commissioners GEO. W. TURNER } "Given to & Subscribed before me, "on Jany 22, 1874. JOSHUA P. CONNAN, Judge PC And said Commissioners having as directed by said Commission brought the proceeds of said (the cash payment) sale amounting to the sum of Three hundred & seventy five dollars, less the sum of Thirty six & 75/100 Dollars which they have expended for Printers fees, their own commission & court cost which is now hereby allowed which sum being deducted from the proceeds of said sale will leave the sum of Three Hundred & Thirty eight 25/100 Dollars to be paid and distributed among the said owners and parties in interest equally. And now on motion of the applicants, It is ordered, adjudged and decreed that said Commissioners distribute said sum of Three hundred & thirty eight & 25/100 among said parties equally as follows: To wit: To RICHARD DAILY, Guardian of RISPA ANN CLEMENTINE JACKSON the sum of Sixty seven & 65/100 Dollars: It is found that they have paid to said DAILY the amt of Sixty seven & 65/100 Dollars as Guardian as aforesaid which discharges in full this decree in his favor. To RICHARD DAILY, Guardian of AMANDA JACKSON, for said AMANDA, the sum of Sixty seven & 65/100 Dollars: It is found that they have paid to said DAILY, Gdn. as aforesaid Sixty seven & 65/100 Dollars which discharges in full this decree in his favor. To SAMUEL JACKSON, the sum of Sixty seven & 65/100 Dollars: It is found that they have paid said SAMUEL Sixty seven & 65/100 Dollars which discharges in full this claim in his favor. To NANCY J. ROPER, wife of JACOB ROPER, GEO W. JACKSON, assignee, the sum of Sixty seven & 65/100 Dollars. It is found that they have paid to said assignee the sum of Sixty seven & 65/100 Dollars which discharges this decree in full. To ALEX JACKSON the sum of Sixty seven & 65/100 Dollars. Jany 22nd, 1874
