To all so _____ ____ Presents may ____ Know ye that I Joseph A. Browning of the state and county aforesaid being at this time of sound mind and memory and taking into consideration the uncertainty of my mortal _____ do make and publish this my last will and testament in manner and form following viz.: After paying all my just debts – I do give and bequeath all my property both real and personal, to my father John Browning during his natural life and at his death to my mother Nancy Browning and at the death of them both to be equally divided between my brothers and sisters of whole blood. In witness whereof I have hereunto set my hand and seal and on my friends Nathaniel Welch John Mallory and Isaac Hudson to subscribe their names as witnesses this tenth day of September in the year of our Lord Eighteen hundred and thirty nine. McAfee Judge county court said county & after first being duly sworn saith that he saw Joseph A. Browning sign seal & publish the within as his last will and testament in the presence of Nathaniel Welch & John W. Mallory on the day and year therein written that John W. Mallory & Nathaniel Welch & this affiant all subscribed their names as witnesses thereto in the presence of each other at the same time & in the presence of said testator; that said testator was at the time of subscribing his name thereto of a disposing & sound mind. Sworn & subscribed Isaac Hudson Before me this third day of November AD 1839 G T McAfee Judge Co Ct Talladega Co Know all men by these presents that John Browning, Isaac Hudson and David M. Browning of the county of Talladega in the state of Alabama are held and firmly bound with Gus T. McAfee Judge of the county court of said county State of Alabama, and his successors in office, a final sum of ten thousand dollars to which payment ___ and truly to be made, _____ of do (hard to read) our heirs __ firmly by these presents, sealed with ____ and ___) the 1st (last?) day of November 1839. Now the condition of the above obligation is ____ that when the above bond John Browning has been duly appointed administrator of the estate of Joseph A. Browning, deceased, with the will annexed. Now if said John Browning shall will___ and truly perform all the ____ which many ____ of his as administrator as aforesaid, then the above obligation is to be ___ also to remain in full force and ____. Browning Talladega Co Additional Comments: Joseph Alanson Browning was the son of John and Nancy Peebles Browning. He died September 15, 1839 according to a transcription of the family Bible. John and Nancy had been living in Lowndes County, Alabama. More research needs to be done to see if they moved from Lowndes to Talladega, as implied in this will, before their move to Clark County, Arkansas where they lived the rest of their lives.
