H. Buchanan of Fort Deposit, in Lowndes County in the State of Alabama, being in failing health, but of sound mind, do make and publish this my last will and testament, hereby revoking all former wills by me made at any time heretofore. As to my worldly estate and all the real, personal or mixed property of which I shall die seized and possessed or to which I shall be entitled at the time of my decease, I devise, bequeath and dispose thereof in the manner following, to-wit: First: My will is that all my just debts and funeral expenses shall by my Executors hereinafter named be paid out of my estate as son after my decease as convenient. Second: I give, devise and bequeath to my beloved wife, Bell Buchanan all my household furniture, including china, glass and plate ware. I also give to her to have ant to hold during the term of her natural life, provided she does not intermarry…My dwelling house and lot on Elen Street, City of Fort Deposit together with all the appurtenances thereunto belonging, as a home forself [sic] and minor children. Third: I give and bequeath to beloved and honored Mother, the income derived from one thousand dollars to be securely invested, by my hereinafter named executors and said income to be paid her semi-annually, at her death the said securely invested one thousand dollars and income there from to revert back to my estate. Fourth: I hereby direct my hereinafter named executors immediately after my demise, or as soon as practical to place my life insurance policy for five thousand dollars with the Bank of Montgomery, Alabama for collection, and when said policy is collected, my executors are hereby authorized to draw on said fund to pay all my just debts, and if the Bank fail or refuse to allow 8% interest on said balance they are hereby authorized to securely invest said balance and the income form said investment goes as a general fund to my estate. Fifth: I give, devise and bequeath to J. P. Buchanan, my son, and Belle Buchanan, my wife in trust for J. P. Buchanan, Eula B. Varner, A. H. Buchanan, Jr., Lottie Buchanan, Porter Buchanan, George Buchanan & Carr Buchanan, all the rest and residue of my estate, real, personal, mixed, and in reversion of which, I shall be _______ or possessed or to which I shall be entitled at my decrease. My said estate to be held in trust and managed in the best manner possible until Carr Buchanan or my youngest child is twenty-one years old. My said Executors are hereby authorized to maintain, support and educate my minor children & widow out of the income of my said estate. Sixth: When Carr Buchanan or my youngest child as above said, reaches the age of twenty-one years, my hereinafter named executors are authorized and directed to divide my estate as follows, to-wit: One Physician’s Office and Lot on which it is situated, east of the Armory in the town of Fort Deposit, Ala., and known as Buchanan’s office, to be given to Dr. J. P. Buchanan in fee. The balance of the estate to be divided equally between J. B. Buchanan, Eula Buchanan Varner, A. H. Buchanan, Jr., Lottie Buchanan, Porter Buchanan, Georgia Buchanan, and Carr Buchanan or their heirs. Seventy: I do nominate and appoint my son J. P. Buchanan and my wife Belle Buchanan to be the executors of this my last will and testament without being required to make bond. In testimony whereof, I the said A. H. Buchanan have to this my last will and testament subscribed my name and affixed my seal this the 29th day of November, 1895. A. H. Buchanan (seal) Signed, sealed and declared by the said A. H. Buchanan as his last will and testament in the presence of us, who, at his request and in his presence, and in the presence of each other, subscribed our names as witness thereto. S. F. McQueen Sidney J. Catts State of Alabama Lowndes County Probate Court of said Court [sic] In the Matter of the Probate of the Last Will and Testament of a. H. Buchanan, dec’d. Before me, A. E. Caffe, Judge of said Court, personally appeared in open Court Sidney J. Catts, who having been by me first duly sworn and examined, did and does depose and say, on oath, that he is a subscribing witness to the instrument of writing now shown to him, and which purports to be the last will and testament of A. H. Buchanan dec’d, late an inhabitant of this County, that said A. H. Buchanan, since deceased, signed and executed said instrument of the day the same bears date and he declared the same to be his last will and testament, and that affiant set his signature thereto, on the day the same bears date as a subscribing witness to the same in the presence of said A. E. Buchanan, and that such other witness subscribed his name as a witness in his presence and in the presence of said A. H. Buchanan, that said A. H. Buchanan was of sound mind and disposing memory and in the opinion of deponent, fully capable of making his will at the time the same was so made as aforesaid. Affiant further states that said A. H. Buchanan was on the day of the said will of the full age of twenty-one years and upwards. Sidney J. Catts Subscribed and sworn to before me this 24th day of Decr. 1895. A. E. Caffee……..
