I Elizabeth Larkins considering the uncertainty of this mortal life and being of sound mind and memory (blessed by the almighty God for the same) do make, publish and declare this my last will and testament in manner & form following, that is to say I give and bequeath unto David Gordon of the county & state aforesaid in trust for the use and benefit of my beloved daughter, Eliza Walker (wife of George Walker) and the issue that are now of her body or may hereafter be ( ___ David Gordon having no other claim or title than that of Trustee, as above expressed) all the property that I may ____ of and in possession of at the time of my death, both real & personal & mixed, to have and to hold in trust for the use & benefit of the said Eliza with the following Exceptions. I will and devise that my Executor give to my brother, Samuel W. Atkinson, if he be living, a certain negro Boy, about 21 years of age, named Charles, that now belongs to me, and if my brother Samuel should be dead, at my death then I want the Boy, Charles, to remain with the Estate, as bequeathed in Trust. I further wish and devise that the Foreign Baptist Ministry Society receive from my Estate the sum of three hundred (300) dollars out of the proceeds of my present crop. And I will and devise that the trustee consult the wishes of my daughter Elizabeth in the management of the property and I also desire that my daughter at her death, shall say & direct how the property shall be divided between the issue of her body, and if she should think any of them undeserving of any portion of the property then they are not to take any share of it. I further wish it to be understood that the children or issue are not to take any take any share of the property during the lifetime of my daughter Eliza. And I further will and desire that all my just debts be paid out of my property before it passes to the Trustee, by Mr. James Greenwood who I do hereby appoint my Executor of this my last will and testament hereby revoking all other former wills by me made. In witness whereof I have hereto set my hand and seal this seventeenth day of June in the Year of our Lord One thousand Eight hundred and forty two. Elizabeth Larkins (her mark) Signed, sealed published and declared by the above named Elizabeth Larkins to be her last will and testament in the presence of us who have hereto subscribed our names as witnesses in the Presence of the Testator. Wm. C. Stewart John H. Walker W. H. D. Hall State of Alabama Lowndes County Personally appeared before me Thomas M. Williams Judge of the County Court for Lowndes County, John H. Walker, who first being duly sworn on the Holy Evangelist of Almighty God, deposeth and saith that he was present on the 20th day of June One thousand and Eight hundred and forty two and saw Elizabeth Larkins sign seal publish and declare the within instrument of Writing as her last will and testament, in his presence, and also in the presence of Wm. C. Stewart and W. H. D. Hall and that he subscribed his name thereto as a witness together with the said Wm. C. Stewart and W. H. D. Hall who also were witnesses in the presence of each other and in the presence of the testatrix and that it was done at her request, and it was in her lifetime & she was of sound deposing mind & memory. Rice, Deputy Clk Additional Comments: Elizabeth Atkinson's first husband was William Browning. She came from Greene Co., Georgia to what became Lowndes County, Alabama with him in about 1818. The only children to survive William and Elizabeth were daughters Eliza, who married George Walker, and Emily, who married John D. F. Williams.
