H. May, all the land I possess at my death, also one sixteen hundred dollar note on Caroline McClelland due January 1st, 1864. Said note to be sold provided slavery is abolished by the present war with the United States and the Confederate State; if slavery is not abolished the said Caroline McClelland and H. McClaud shall pay said note to my son, W. H. May whenever they think he needs it. 2nd: I give and bequeath unto my daughter, Caroline McClain and Sarah A. Dennis all my household furniture that I am possessed of my death. 3rd: I give and bequeath unto my son, Simon B. May, Wm L May, James May, J. C. B. May, M. P. May, A. S. May, and the heirs of John May, each one my sons named in the 3rd Item five dollars each, also the heirs of my son, John May five dollars to paid ____ my death after my death. 4th: I do nominate and appoint my son-in-law H. McClain and my daughter Caroline McClain to be the executors of this my Last Will and Testament to control and manage the amount I have willed to my son, W. H. May, as they think best for him to support upon and also my Executors to this my Last Will and Testament. In testimony whereof to this my Last Will and Testament I then hereunto set my hand and seal this October 28, 1864. her Susan X May mark Signed, sealed, declared and published by the said Susan May and for her last will and Testament in presence of us, who at her request and in her presence, and in the presence of each other have subscribed our names as witnesses hereto. Collier] The State of Alabama, Lowndes County Probate Court of said County In the Matter of the Probate of the Last Will and Testament of Susannah May, dec’d. Before me, James W. Graham, Judge of Probate Court, in and for the County and State aforesaid, personally appeared in open Court, J. J. Evan who having been by me first respectively duly sworn and examined did and does depose and say that affiant is a subscribing witness to the instrument of writing now shown him, and which purports to be the Last Will and Testament of Susannah May, deceased, late an inhabitant of the County, that the said Susannah May, since deceased, signed and executed said instrument on the day the same bears date, and declared the same to be her last Will and Testament, and affiant set his signature thereto on the day the same bears date with W. P. Collier as a subscribing witness to the same, in the presence of said Testatrix and in the presence of each other subscribing witness, that said Testatrix was of sound mind and disposing memory and in the opinion of deponent, fully capable of making her last will and testament at the time the same was so made as aforesaid. Affiant further states that said Testatrix was on the day of the said date, of the full age of twenty-one and upwards. J. J.
