All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/al/alfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Carolyn Golowka http://www.genrecords.net/emailregistry/vols/00012.html#0002972 March 26, 2007, 1:04 pm Source: Lowndes County Court, Will Book C, Page 81 Written: July 4, 1863 Recorded: May 13, 1867 Will of Robert McFerrin Lowndes County, Alabama Will Book C, page 81 Know all men by these presents, that I, Robert McFerrin of the County of Lowndes and State of Alabama, considering the uncertainty of this life and being of sound memory, do make, declare and publish this my last Will and Testament, that is to say: I will and bequeath unto my beloved wife, Melvin[a] McFerrin all my entire Estate, both personal, real of whatever kind or quality it may consist, to have and to hold to her own proper use so long as she remains my widow, but should my said wife enter into another marriage contract, then and at that time it is my will that my property be equally divided between my wife and children without favor or affection. And further, it is my will that my said wife, Melvin[a] McFerrin settle all my debts and receive and receipt for all moneys due me without administration on my Estate, and I hereby authorize and empower her so to do and act, and it is my will that my said wife manage my property as she may think best of herself and children, my object being for her to settle up my business and retain my property together and carry on the farm for her interest and for the support of the family without troubling her with an administration of my Estate and without keeping any account between the children until she marry the second time or until her death. In testimony whereof, I have to this my last will and testament subscribe[d] my name and affixed my seal on this the 4th day of July, 1863. Robt. McFerrin as and for her [sic] last will and testament, in presence of us, who at his request, and in his presence, and in the presence of each other have subscribed our names as witnesses hereto. E. D. Lavender R. D. Twombly The State of Alabama, Lowndes County. Before me, James W. Graham, Judge of the Probate Court of said County, personally appeared, in open Court, E. D. Lavender, who having been by me duly sworn and examined, did and does depose and say on oath, say that he is a subscribing witness to the instrument of writing now shown to him, and which purports to be the last will and testament of Robert McFerrin, deceased, late an inhabitant of this County, that said Robert McFerrin, since deceased, signed and executed said instrument on the day the same bears date, and declared the same to be his last will and testament, ant that affiant set his signature thereto on the day the same bears date, as a subscribing witness to the same, in the presence of said Testator, that said Testator was of sound mind and disposing memory, and, in the opinion of deponent, fully capable of making his will at the time the same was made as aforesaid. Affiant further states that on the day of the date of said Will of the full age of twenty-one years and upwards. Subscribed and sworn to May 13, 1867 E. D. Lavender James W. Graham Judge of Probate. Graham Judge of Probate Additional Comments: Robert M. McFerrin was born October 12, 1825, a son of John & Margaret McFerrin He married Melvina Annis Moorer, daughter of John L. S. Moorer and Roxanna Livingston. Melvina was born September 17, 1829 and she died May 23, 1918. Robert died January 12, 1867 and was buried in the Hopewell Cemetery, Palmyra, Lowndes County, Alabama. They had at least 10 children: John Ellis, William Henry, Rebecca Elizabeth, Edgar J., Sarah "Sallie" J., Jesse Grier, Eugenia M., Robert J., Duane J., and Melvina A. Melvina remarried on Mar 28, 1869 to John William Flowers.
