Middleton, being of sound mind and disposing memory, do make and publish this my last will and testament, hereby revoking all former wills by me at any time made. Item 1st: I direct that all of my just debts including funeral expenses to be paid by my executors. Item 2nd: I bequeath to my beloved wife, Amanda Middleton five hundred dollars to be paid by my executors as soon as practicable after my decease, also all of my household and kitchen furniture and two cows of her selection. Item 3rd: I bequeath to my beloved daughter, Mrs. Elizabeth R. Gist, two hundred dollars to be paid by my executors as soon as possible after my decease. Item 4th: I divise [sic] and bequeath all of the residue and remainder of my estate both real and personal to my wife and children who shall survive me and to the legal issue of any deceased child or children in equal parts. Item 5th: My executors hereinafter named shall have the power and the right to sell and convey and to make title to the purchasers of any or all of the residue or remainder for the purpose of any equal distribution among my wife and children. Item 6th: That I hereby appoint my sons, T. Calloway Middleton and David H. Middleton as my executors of this my last will and testament without bond, having full confidence in their judgement and honesty to carry out the provisions of my will. In witness whereof, I have hereunto set my hand this the 15th day of June 1885. Th. J. Middleton State of Alabama, Lowndes County Probate Court of said County. In the Matter of the Probate of the Last Will and Testament of Thos. J. Middle, dec’d. Before me, A. M. Caffee Judge of the said Court, personally appeared in open Court, J. N. Gowan, who having been by me first duly sworn and examined, did and do depose and say on oath, that he is a subscribing witness to the instrument of writing now shown to him, and which purports to be the last will and testament of Thomas. J. Middleton, deceased, late and inhabitant of this County, that said Thos J. Middle, since deceased, signed and executed said instrument the day the same bears date, and declared the same to be his last will and testament, and that affiant set his signature thereto on the day the same bears date as a subscribing witness to the same, in the presence of the said Thos. J. Middleton, and that such other witness subscribed his name as a witness in his presence and in the presence of the said Thos. J. Middleton, that said Thos J. Middleton was of sound mind and disposing memory, and in the opinion of the deponent, fully cabable of making his will at the time the same was so made as aforesaid. Affiant further states that Thos J. Middleton was on the day of the date of said will, of the full age of twenty-one years and upwards.
