Miller of the town of Benton, County of Lowndes and State of Alabama, being of sound mind, do make this my last will and testament. 1st: I want all my just debts paid. 2nd: I give, devise, and bequeath to my wife, Julia Rosa Miller, and all her heirs, forever, all my property, personal or real, as may such possess at the time of my death. 3rd: I want my business to be carried on by my wife, Julia Rosa Miller and my son Willie W. Miller shall be assistant Executor to assist her in carrying on the business without any bond by him being given. All my property, real or personal shall be under Julia Rosa Miller’s control as long as she lives and after her death, shall be equal.. divided among my children. In witness thereof..I have set my seal and signature tho this my last will and testament this Aug. 30th, 1886. J. H. Miller (L.S.) Signed and sealed this instrument, Aug. 30th, 1886, same as his will and testament and at his request and in his presence and in the presence of each of us, have hereunto written our names as subscribing witnesses this Aug. 30th, 1886. A. Richards (L.S.) E. I. Cadden (L.S.) State of Alabama Lowndes County Probate Court In the Matter of the Probate of the Will and Testament of J. H. Miller Deceased. Before me, A. E. Caffee, Judge of Probate Court in and for said County and State aforesaid, personally appeared in open Court, A. Richards who having been by me first duly sworn and examined, did and does depose and say that he (A. Richards) subscribing witness to the foregoing instrument now shown to the Affiant, and which purports to be the last will and testament of J. H. Miller, deceased, late an inhabitant of this County, that the said J. H. Miller, since deceased, signed and executed said instrument on the day the same bears date, and declared the same to his last will and testament, and that affiant set his signature thereto on the day the same bears as a subscribing witness to the same in the presence of said testator, and at his request and in the presence of each other, and that said testator was of sound mind and disposing memory and understanding, and in the opinion of affiant, fully capable of his making his said will a the time the same was so made as aforesaid, and deponent further states that said testator was, on the day of the date of said will of the full age of twenty-one years and upwards, and a resident of this County. A. Richard [sic] Subscribed and sworn to before me this twentieth day of August, A. D. 1896. A. E. Caffee Judge of Probate Court, Lowndes Co. State of Alabama Lowndes County I, A. E. Caffee, Judge of the Probate Court in and for the County and State aforesaid, do hereby certify that the within instrument of writing, has this day in said Court, and before me as the Judge thereof, been duly proven by the testimony of A. Richard subscribing witness to the genuine last will and testament of J. H. Miller, deceased, and that said will together with the proof thereof, has been duly recorded in my office in Book No. C of Wills at page….. In witness, Whereof, I have hereunto set my hand and affix my seal of said Probate Court, on this the 26th day of August, A. D. One Thousand Eight Hundred and Ninety-six. A. E.
