First. I desire that all my just debts and funeral expenses shall be paid out of my estate as soon as it can be conveniently done. Second. I bequeath and desire to my beloved son John Gilchrist of North Carolina my Negro boy Ephraim now in his possession and also a two thirds interest which I now hold and own in a Negro woman called Letha and her child, also now in N. Carolina, in the possession of my son John and also my undivided estate and interest in the lands desired to me and my two sons James G. Gilchrist and the said John by he last will and testament of my late husband Angus Gilchrist to the said John Gilchrist and his heirs forever. And I also bequeath to my said son John the sum of one thousand dollars to be paid to him by my Executor as hereinafter directed. Third. It is my will and desire that the money which is to be paid by J. Bullock for the lease of my plantation and Negroes for the years 1850 & 1851 shall be applied to the payment of my debts in preference to other property by my Executor. It is my will and desire that my Executor shall keep all my estate together except the slaves and lands given above to my son John, and carry on a farm with the slaves and stock upon my lands where said Bullock now resides in Lowndes for the space and term of five years from and after the first day January 1852 of which time the lease of said Bullock expires. It is my will and desire that my Executor shall pay to my said son John his monetary legacy of one thousand dollars above stated out o the proceeds of said farm as follows – that is to say, two hundred dollars at the end of year 1852 and two hundred dollars at the end of year 1853 – and the same sum at the end o f1854, and the same sum at the end of 1855, and the same sum at the end of 1856 making the sum of one thousand dollars above bequeathed to my said son John, and to be in full of ___ same – and the said proceeds of the said estate after discharging the said several installments, my Executor is then directed at his discretion to appropriate to the use import and maintenance of my son James G. Gilchrist and his family until the end of the said year 1856. It is further my will and desire and I hereby bequeath and desire all my property in Alabama, that is to my lands in Lowndes County which is occupied by said J. Bullock consisting of three hundred and sixty acres more or less, and my slaves Charles about forty years old, Pri___ about 24 years old, John about seventeen years old, Jim and Henry about 16 years old, Eliza about 25 years old and her our children: Jane, Ann, Wesley, Jim, and an infant – Also Linda about 28 years old and her five children: Eliza Jane, Flora, Sam, Kitty and Anna – Also Melia and her two children: Bettie and Nancy and Melia about 55 years and their increase. To my said beloved son James G. Gilchrist of said Lowndes County to take effect from and after the expiration of the year 1856 and to his heirs forever, provided my said son James shall be in life at that time, and in care my said son James shall have departed this life before that time, then and in that case I bequeath and desire all lands and slaves in this item specified to the lawful children of said James or child then in life, share and share alike to them and their heirs forever. And in care that no one o ten then shall be in life, then to my right(ful) heirs forever. All the rest and residue o my estate I give to my said son James forever. I hereby authorize my Executor herein after named if he shall think proper to do so at any time, to sell the lands above devised in Lowndes County and to appropriate the money arriving from such sale, to the purchase o other ands for the protection of a farm according to the intent o this will as he may deem it expedient for the parties concerned which lands shall be subject to the uses and limitations herein applied to the foregoing lands in Lowndes County, for the satisfaction of my beloved children and all friends devise it to be distinctly and particularly understood that any difference which has been made in the amounts of the legacies of said two sons is caused solely by the difference in their _____ condition and not in the least respect from a partiality of want of love for one more than the other. They are both alike dear to me. I do hereby constitute and appoint my beloved son James G. Gilchrist the sole executor of this my last will and testament with full power to execute the same. And it is my desire that he shall give no bond to the Judge o the Orphans Court or to any ___ for the faithful discharge of his duty but shall be permuted to act as Executor without any such bond. In witness whereof I now declare and publish this as my last will and Testament and have hereunto set my hand and seal this day of August 1850.
