I know that life is uncertain, I desire to make my disposition of my property. After all my just and lawful debts are paid, I give unto my wife, Rachael Omelia Ann Michum, all of my real estate consisting of two hundred and eighty acres of land, more or less, all lying in said county and state, with all of the improvements attached thereunto, also a Negro woman, Rose, girl Hannah Clarinda Mayony one horse, twenty head of cattle, all my household & kitchen furniture and the following property, to wit: a boy Read, his wife, Mahala, and their children Frances, Jane, Alexander; a girl Jane, woman Narcissa with the balance of the stock and one mule all to be kept together. If there should be any child or children born after my death that was lawfully begotten of my body by me such child or children are to remain with their mother until they become of age, then the property is to be equally divided between said wife and such child or children. And in case said wife should again after my death intermarry I desire that all the property be equally divided between the said heirs of my body and said wife. It is my desire that my wife shall sell the track of land in Lowndes County in the neighborhood of Vasser's, and buy or purchase a tract of land for a homestead near Judge Moore's on Big Swamp Creek, for said wife and children. I tis my desire that in case my wife and child or children as the case may be should all died that the said property revert to my mother and sisters. It is my express wish that Judge L. D. J. Moore be my Executor of this my last will and testament. In testimony whereof I hereunto affix my hand and seal this the 29th day of June, the year of our lord eighteen hundred and fifty two. Vasser On this, the 30th day of June 1852, I Lawson Mitchum, being of sound mind and disposing memory, do hereby ordain and establish the following as part and parcel of my last will and testament executed on the 19th of June, 1852 to wit: that the said Executor therein appointed shall not be required to give the bond usually given by such Executor or administrator having full confidence in his honesty and integrity to discharge such duty without such bond. Vasser, one of the subscribing witnesses to the foregoing instrument in writing purporting to be the last will and testament of Lawson Mitchum, deceased, late of said county. Also to the codicil thereto annexed, and being sworn on the Holy Evangelist of the Almighty God deposeth and saith that he saw said Lawson Mitchum in his lifetime sign, seal, publish, and declare the same to be his last will and testament including the codicil thereto. That said Lawson at the time of signing the name was of sound and disposing mind and memory and that he, the deponent, together with the other subscribing witnesses, William Foster and A. J. Reese subscribed their names thereto in the presence of and at the request of said decedent, and all in the presence of each other on the day and year therein written, and further, that he, said deponent, and the other witness, T. W. Key subscribed their names to the codicil in the presence of said Lawson and in the presence of each other the day and year therein written. Sworn to in open court Jno R.
