This file is copyrighted and contributed by: Carolyn Golowka ==================================================================== September 2004 Will of Zebulon Rudulph, Junior Lowndes County, Alabama Will Book B, pages 302-303 State of South Carolina Zebulon Rudulph, Junior, of Edgefield District and State aforesaid, being of sound and disposing mind and memory but calling to mind the uncertainty of life and desirous to dispose of all such worldly estate as it has pleased God to bless me with, do make and ordain this my last will in manner following, that is to say – From the proceeds of the crop on my plantation in Lowndes County, Ala. I wish all my just debts and funeral expenses paid as early as possible after which it is my wish that my executor should pay to my esteemed friend Mrs. Martha Mims, now living in Columbus, Georgia such a sum as may be the residue of eight hundred dollars (such part of the eight hundred dollars as I may pay her I will leave vouchers for) in three equal annual payments, or earlier if it can be don with convenience. I give to my infant son, John Barratt Rudulph, all my Negroes, namely Tom and his wife Pricilla and their children Mena, Lifey, Peny, Adeline, & William; will and Nancy his wife and children, Sophy, Stephen, Abram, Celia and July; Nanny & her children Ellen, Chaney, Elizabeth, Lindy, Mary & Margarett; Hannah and her children Doll & Andrew; Dee and her child Winney.and 3 boys Harry, Larry and Joe, and the men Charles Minter John and Tim and all the issue of the above named Negroes. Also the plantation in Lowndes County, Ala. With all the stock thereon and all other real or personal property of which I may die possessed, together with three fourths of the net yearly proceeds of the plantation. The other fourth to my sister, Eliza Y. Peay, during the time of my son's minority to be received by my brothers John and Burwell B. Rudulph in trust for her. IN case of the death of my son above named during tht life of my father, Zebulon Rudulph, Senr., it is my will that all the foregoing bequeath to my son, John Barnett Rudolph, shall ___ to be invested in my father, Zezulon Rudulph, Senr. and his heirs forever. But in the event of the decease of my son after the decease of my father and during my said son's minority, then that all my said estate shall be valued and to my brothers John & Burwell B. Rudulph and my sister Sarah Murray Manly and their heirs. I do give, bequeath and devise one fourth part to each and to my brothers John & Burwell B. Rudolph. I give, bequeath and devise in trust to and for the sole and separate use of my sister Eliza Yeates Peay the other fourth part. The said trust to continue during the life of her husband, Austin F. Peay, unless they be reconciled and she should return to him in such event or his death the trust immediately to terminate after which period I devise and bequeath the said fourth part of my estate to my sister Eliza Y. Peay in fee simple forever. I desire my executors to have my servant Tom treated and provided for as a privileged servant and that the families of Negroes shall in no case be separated and lastly, I do constitute and appoint my father, Zebulon Rudulph, Snr., John Rudulph & Burwell B. Rudulph executors of this my last will and testament and do hereby entrust them or the survivor of them with full powers as such.
