It would not be 1865 because Clinton was killed July 22, 1864 and is buried in the Oakview Cemetery, Lowndesboro, Lowndes Co., AL. The correct year is to be determined. The State of Alabama } Lowndes County } In the Name of God, Amen! I, Clinton Hunter, of the State and County aforesaid, being of sound mind and memory, and considering the uncertainty of life frail and transitory life do therefore, make, ordain, publish and declare this to be my last will and testament, that is to say: After all my lawful debts are paid and discharged, the residue of my Estate, to-wit: Sam, a Negro man, a slave for life, Molly, a woman, Mingo, a boy, Walter, a boy, Oscar, a man, Lilly, a girl, Adaline, a woman, Amy, a woman, and Jim, a boy, together with all and singularly their household and kitchen furniture, the houses, mules, cattle and stock of every kind and description whatsoever, with all and singular the Estate of which I may died seized and posses with real, personal or mixed or whether consisting of things personal or things in action, I give and bequeath unto my beloved wife, Mary Jane Hunter, to have and hold unto the said Mary J. Hunter, my beloved wife aforesaid, in her absolute right forever. Should I die before the said Mary Jane Hunter without issue from her, the said Mary J. Hunter. Likewise, I make, constitute and appoint my beloved wife, the said Mary Jane Hunter, to be the sole Executrix of this my last will and testament, and it is further my will and request that my said Executrix, my beloved wife, the said Mary Jane Hunter,, shall be exempt from giving bond as is required by law in other and like cases, and I do hereby especially exempt my Executrix form the necessity thereof. In witness whereof, I have hereunto set my hand and subscribed my own proper name, and affixed my seal on this the eighteenth day of September, One thousand eight hundred and fifty-five. C. John P. Streety Cornelius cook H. W. Hardy The State of Alabama } Lowndes County } Probate Court, August 29th, 1864 In the Matter of Probating the Last Will of Clinton Hunter, Deceased. Before me, James W. Graham, Judge of the Probate Court of said County, personally appeared in open court, John P. Streety, Jr., who, having been by me first duly sworn and examined, does and did depose and say that he has seen a letter written the last five days from his father, John P. Streety, that said John P. Streety is in the Military Service of the County, absent from home, and to the best of his knowledge information and belief is now in the State of Georgia. Subscribed and sworn to before me the J. P. Streety, Jr. above day written. James W. Graham Judge of Probate Before me, James W. Graham, Judge of the Probate Court of said State and County, also personally appeared in open Court, John J. McCaw who, having been by me first sworn and examined, did and does depose and say that he is acquainted with the handwriting of John P. Streety, that he has often seen him write, that he also knows the handwriting of R. W. Hardy, now declares that he saw Hardy write in his lifetime and that said Hardy is now dead, and that the names of John P. Streety and R. W. Hardy appearing as subscribing witnesses to the instrument of writing now shown to him and purporting to be the last will of Clinton Hunter are the genuine signatures of John P. Streety and R. W. Hardy, and that the said Cornelius, the other subscribing witness to said will has departed this life. Sworn to and subscribed before me John J. McCaw This 26th day of August 1864 James S. Graham Judge of Probate The State of Alabama } Lowndes County } Probate Court, August 29th, 1864 Before me, James W. Graham, Judge of the Probate Court of said County, personally came John T. Jewell and M. J. Fagg, who, having by me first duly sworn and examined, did and do depose and say that they are well acquainted with the hand writing of C. Hunter, now deceased, and that the signature attached to the instrument of writing now shown to witnesses, purporting to be the last Will of Clinton Hunter, is the genuine signature of said Clinton Hunter, that witnesses saw said Hunter frequently in his lifetime, that said signature is in his handwriting and that they are also acquainted with the handwriting of John P. Streety and that sinature attached to said Will as a subscribing witness is the handwriting of John P. Streety. Subscribed and sworn to before me J. T. Jewell this August 29th 1864 M. J.
