This file was contributed and copyrighted by: Carolyn Golowka http://www.genrecords.net/emailregistry/vols/00012.html#0002972 ================================================================================ September 1999 Will of Ithiel Ingram Lowndes County, Alabama Will Book C, pages 207 - 208 The State of Alabama, Lowndes County I, Ithiel Ingram, of the State of Alabama, Lowndes County, being in feeble health but of sound mind and memory, do make and publish this my last will and testament in the manner and form following, to-wit: First: I will that my just debts, which consist on of doctors bill and my funeral expenses, shall be paid out of money and cotton - on hand, as soon after my decease as may be convenient. Second: I bequeath to my nephew, William J. Roberts, two bales of the cotton that I now have on hand. Third: I give and bequeath to my three sisters, Eliza Ingram, Mary Ingram, and Sarah A. Ingram, in fee simple, the following lands known as my 'home place,' to-wit: east half of north east quarter of Section thirty three (33) in Township thirteen, Range twelve; northwest quarter of northwest quarter of Section thirty-four (34), Township thirteen (13), Range twelve (12); that part of northwest quarter of southwest quarter of Section thirty three (33), Township thirteen, Range twelve which lies north of Braggs and Elva Bluff Road, and seven acres in northwest corner of Section twenty-seven, Township Thirteen, Range twelve, all in the State of Alabama, Lowndes County, and containing about one hundred and thirty-seven acres, together with all crops and appurtenances belonging and all farm implements, tools, machinery, gin, wagon, all cows, cattle and poultry, now on hand, and that may hereafter be on hand. I further give and bequeath to my said sisters, one mule 'Kate,' all of my interest in the crop the present year of January Ingram and all of the money and cotton not hereafter bequeathed that I have on hand or in the hands of others either on deposit or loaned out. I further bequeath to my said sisters, twelve hogs to be selected by them from my stock of hogs. Forth: I give and bequeath all of the residue of my property of every kind whatsoever to the following persons, to-wit: my sister, Nancy Wheeler, Emily Tool, and Lucinda Wiggins, and my nephew, William J. Roberts each to have 0ne-seventy of said residue, and the heir of my brother, Irod Ingram, to have one-seventy, the heirs of my brother, Isaac Ingram, to have one-seventh and the heirs of my brother, Marshall Ingram, to have one-seventh of said residue of property. Lastly: I appoint my sisters, Eliza Ingram, Mary Ingram, and Sarah A. Ingram to be Executors of this my last will and testament and will that they be not required and give bond for faithful discharge of their duties as such Executors. I hereby declare this to be my last will and testament revoking all wills previously made. In testimony whereof I have herewith set my had and seal this the 20th day of May, 1885. Before me, H. W. Caffey, Judge of said Court, personally came J. S. Dudley, who having been by me duly sworn and examined, deposes and says that each of the persons names are subscribed as witnesses to the paper purporting to be the last will and testament now shown to him of Ithiel Ingram, late of said County, deceased, subscribed and signed their names as witnesses thereto. That said Ithiel Ingram, since deceased, signed and executed said instrument of writing on the day the same bears date and declared the same to be his last will and testament, and that affiant and the other persons named as witnesses, viz: J. L. Crosby and P. J. Rash, respectively, set their names thereto on the said date as subscribing witnesses in the presence of and at the request of the said testator, and in the presence of each other, that said testator was of sound mind and disposing memory and. in the opinion of affiant. fully capable of making his last will at the time the same was made, that said testator was over the age of twenty-one years at the said date.
