I, John Gresham, of said State and County, of lawful age, of sound mind and disposing memory, do make and establish this as my last will and testament as follows: 1st: It is my will that, after my death, all my legal and just debts be first paid. 2nd: I give and bequeath to my youngest child, Tolbert, six thousand dollars, to be paid him out of my Estate as property justly due him through his mother, deceased. 3rd: I then further will and desire, after paying my just debts and the six thousand dollars specially bequeathed to my son, Tolbert, in cause second, that my whole estate, both personal and real, remaining, e equally divided each to share and share alike, between my three (four) children: John, Francis, Robert M. and Tolbert Gresham. 4th: I further will and desire that in dividing my Estate as in clause three, there is no change to be made for any advances made either of the children during my life time. Given under my hand and seal in the presence of witnesses, January the eleventh, Eighteen hundred and seventy-two. In presence of Jno. Gresham ( ) W. W. Golson S. Gresham The State of Alabama Lowndes County This day personally came before me, J. V. McDuffie, Judge of Probate Court, in and for said County and State aforesaid, W. W. Golson, who, being duly sworn by me, doth depose and say as follows: First, affiant is one of the subscribing witnesses to the foregoing paper writing purporting to be the last will and testament of John Gresham, dec'd, that affiant was present together with other subscribing witness, S. Gresham, at the house of the said John Gresham, on the day the same bears date in Lowndes County, Ala., and that the said John Gresham signed the said paper writing on the day the same bears date as his last will and testament, and signed the same in the presence of affiant and the other subscribing witness and that affiant signed the same as a subscribing witness with the said S. Gresham, who also signed as a subscribing witness, that said testator signed the same in the presence of said affiant and the other subscribing witness as last will and testament and that affiant and said Gresham signed the same as subscribing witnesses in the presence of each other subscribing witness and in the presence of said testator, that said testator was at the time of making and executing said last will and testament of sound mind and disposing memory, and over the age of twenty-one years.
