Kirkpatrick Lowndes County, Alabama Will Book C, page 248 The heirs names were all his children as confirmed in the 1850 and 1860 US Census, Lowndes Co., AL In the Name of God, Amen. I, John L. Kirkpatrick, residing near Fort Deposit in the county of Lowndes and State of Alabama, being of sound mind and memory and considering the uncertainty of life, do therefore make, ordain, publish and declare this to be my last will and testament. First: After all my lawful debts are paid and discharged, the residue of my Estate, real and personal, I give, bequeath and dispose of as follows, to-wit: To my beloved wife, Rachel L. Kirkpatrick, the house and 163 acres of land known as my residence numbers as follows: NE 1/4 Section 27, Township 12, Range 15, and 3 acres of NW 1/4 of same Section, Township and Range, together with all appurtenances situated thereon, during her life, also what ever horses, mules, cows, hogs, farming implements and provisions may be on hand at the time of my decease; also $200 per annum, during her lifetime, the aforesaid lands and houses to be equally divided between my legal heirs, and also all stock, farming implements, provisions and money, whatever property she may own at the time of her decease. Furthermore, my Executors shall be empowered and directed to control all money, notes and securities on land at the time of my decease, to secure the aforesaid $200 per annum to my wife. Second: All other lands in my possession not herein specified shall be equally divided between my heirs: Mrs. E. J. McFarland, William M. Kirkpatrick, Martin W. Kirkpatrick, Robert W. Kirkpatrick, Milton A. Kirkpatirck, and Junius W. Kirkpatrick. Likewise, I make, constitute and appoint my sons, Martin W., and Junius W. to be Executors of this my last will and testament. In witness whereof, I have hereunto subscribed my name and affixed my seal this 15th day of February, in the year of our Lord, One thousand Eight hundred and Eighty-seven. John L.
