Spann, Codicil Lowndes County, Alabama Will Book C, pages 150 - 151 The State of South Caroline Sumter County In Probate Court Re: Lawrence M. Spann, Dec'd Last Will and Testament Codicil to my Last Will and Testament I do hereby give to my daughter, Ella, the Woodstock tract of land, one hundred and fifty three acres in the event my son, James C. Spann shall acquire it for me on a certain note on R. D. Spann and the credit of one thousand dollars on the J. G. Spann's note, which I have given to my son, James C. Spann, and the payment of four hundred dollars and out of my estate in lieu of her forth of the Mill Tract, south and east of the Staleburgh road, including where D__ Vaughn now lives, in place of the credit made on said note; and he shall have the power to dispose of said land if he feels so disposed. Then the remaining portion of the Mill Tract I wish divided unto three equal shares between my son, James C. Spann, my daughter Harriett M. Carson, and my two grandchildren, Lawrence and Anna Carson, who shall be entitled to one child's portion. In witness whereof, I have hereunto set my hand and seal this the thirty first day of august, one thousand eight hundred and seventy-four. Witnesses: Signed: L. M. Spann (Seal) W. W. Hudson E. B. Exum, who being duly sworn made oath, and saith that he saw Laurence M. Spann sign, seal, publish, pronounce and declare the annexed instrument of writing, bearing date the thirty-first day of August, 1874, to be a codicil to his last Will and Testament; that he, the said Laurence M. Spann, was then of sound and disposing mind, memory and understanding, according to deponent's knowledge and belief, and that the said deponent together with William W. Hudson and John A. Miller at the request of the testator and in his presence and in the presence of each other, witnessed the due execution thereof. Sworn to and subscribed before me this 29th E. B.
