I William Robinson of the County and State aforesaid, being of sound mind and disposing memory, do make, sign and publish this writing as my last will and testament as follows: 1st: That it is my wish and desire as soon after my death as it can conveniently be done, that all my just debts be paid from the moneys of my Estate. 2nd: I give and bequeath to my children (in Texas) Robt. T. Robinson, Henry W. Robinson and Gilbert Robinson my entire interests in all my lands in the State of Texas, to be equally divided between each, to share and share alike in said lands, to have and to hold to their separate use, and they or neither of them shall be required to account to my Estate for any profits rents or income from said land. 3rd: I give and bequeath to my beloved daughter, Mary E. Brown, my plantation in Lowndes County, Alabama, known as the Harrison place on which she now resides to her sole and separate use during her life, and after her death to the heirs of her body, and it is my wish and I hereby will and direct that my daughter, Mary E. Brown have the use and control of the profits and income arising from said plantation to use as she may deem best free from the control of her husband. I also give and bequeath to my daughter Mary E. my black mare, Bess, and my no top bubby and harness. I also give and bequeath to my grandson, Ware Brown, son of my daughter Mary E. Brown my bald face colt, to have for his use and benefit. 4th: I give and bequeath to my son, Cornelius Robinson, my interest in the plantation lying on Big Swamp Creek in Lowndes County, known as said Cornelius place to his sole and separate use, and that he, Cornelius, shall not be required to account for any profits or income from said plantation. I also give to my said son, Cornelius, my horse, Stallion Livingston to his separate use, and I also give to my son, Cornelius, my interest in Mobile mare and colt in his separate property. 5th: I give and bequeath to my son, Eli T. Robinson, my plantation in Lowndes County lying on the Alabama River known as Lochranza, and my residence house and lot in Lowndesboro, and the lands attached thereto, consisting of sixty acres, more or less, to have and to hold to his separate use. 6th: For the regard and affection I have for Emma Robinson, wife of Tarlton, for the many kindnesses and services rendered me as a servant, I give and bequeath to said Emma my house and lot in the City of Montgomery lying in the rear of the lot of J. W. Hale, on which lot there is a f____ building and stable to her own separate use and benefit. 7th: And having every confidence in the honesty and integrity of my son, Cornelius Robinson, I hereby nominate and appoint him as my Executor, and that it is my wish and request that he shall not be required to give security on his bond as my Executor. In witness whereof, I have hereunto set my hand in the presence of two witnesses this the thirteenth day of May, Eighteen Hundred and Seventy Eight. 8th: I further will and direct my Executor to see all personal property, stock, horses &C not herein bequeathed for cash and the money belonging to my Estate to be equally divided between my children all legal heirs. S. Gresham Wm. Robinson P. N. Cilley In Lowndes Probate Court, Jany 22nd, 1883 In the matter of the Probate of the Last Will and Testament of William Robinson, deceased. I, P. N. Cilley, one of the subscribing witnesses of said Will, who being duly sworn, deposes and says: that he knew William Robinson in his life time, that he was a resident citizen of the County of Lowndes and State of Alabama, and over the age of 21 years, that he was present when William Robinson executed the instrument now propounded for probate, and S. Gresham was present and that Wm. Robinson executed the same in his presence, that he attested the same in the presence of said Robinson they signing their names in the presence of each other, and that William Robinson at the time of the execution of the same was of sound mind and disposing memory. Caffey Probate Jud Additional Comments: William Robinson, son of Tod & Martha Terry Robinson of Autauga County, came to Alabama with his father, mother, and siblings from Anson Co., NC sometime around 1817-1819. William married Eliza Jane Ware, daughter of Robert Ware of Montgomery County, on April 15, 1825. According to some decendents, this marriage was against Robert Ware's wishes. William and Eliza lived in Lowndesboro, Lowndes County, AL where they are buried in the Oakview Cemetery with some of their children and grandchildren. Sons Robert, Gilbert and Henry, who are named in the will as living in Texas, went to what was Polk County, later San Jacinto County, and they are buried there.
