Lee Lowndes County, Alabama Will Book C, page 87 In the Name of God, Amen! I, S. W. Lee, of the State of Alabama and County of Lowndes, being of sound mind and memory, Blessed be God, for the same, do make and publish this my last will and testament. 1st: It is my desire and will that all my just debts be paid. 2nd: I wish all my Estate to be kept together both real and personal property by my beloved wife, Nancy, during her natural life or widowhood for the use of her benefit and that of my children, and if any of my children should marry during my wife's lifetime, I give her the right to help them in any way she may think right and proper, and after her death, then I desire all my Estate both real and personal to be equally divided among all my children by lot, if it can be done, by equally dividing the lots, if not, by sale of same, or so much thereo as may be sufficient to equal the lots. 3rd: I do nominate and appoint my beloved wife, Nancy, to be Executrix of this my last will and testament. In witness whereof, I have hereunto set my hand and affixed my seal in the presence of the undersigned witnesses and in the presence of each other, this eighth day of December, in the year of our Lord, One thousand eight hundred sixty-four. Graham, Judge of the said Court, personally appeared Joseph Soles, in open Court, who, having been duly sworn on oath, says that he and James D. Moorer are subscribing witnesses to the will of S. W. Lee, now shown to him, that said S. W. Lee, late an inhabitant of said County, but now dec'd, that said Deceased signed and executed the said instrument on the day the same bears date, and declared the same to be his last will and testament, and that witness and said James D. Moorer set their signatures thereto on the day the same bears date, as subscribing witnesses to the same in the presence of said Testator, that said Testator was of sound mind and disposing memory, and, in the opinion of deponent, fully capable of making his will at the time the same was so made, as aforesaid. Affiant futher states that Testator was on the day of the date of said Will of the full age of twenty-one years and upwards. Jos. Soles Subscribed and sworn to Nov. 7th, 1867. James W.
