McPherson, Sr. Lowndes County, Alabama Will Book D, pages 308 – 310 The State of Alabama } In the name of God, Amen Lowndes County } Know all men by these presents, that I, John C. McPherson, Sr., of said State and county, being of sound mind and disposing memory, and being also aware of the uncertainty of life, do hereby make, declare and publish this my last will and testament, hereby revoking and all forms wills and codicils thereto by me mat anytime heretofore made. Item One – I hereby nominate and appoint my beloved wife, Mannie B. McPherson, the Executrix of this, my last Will and testament, and I do hereby relieve her of the requirement of giving bond before qualifying as such. And further do hereby relieve her of the necessity of making any report to or any accounting of settlement with any Court whatsoever of her acts and doings as such Executrix. Item Two – I hereby direct that all of my just debts be paid by my said Executrix heretofore named, as soon after my death as may be found by her to be practicable and convenient. Item Three. I hereby will, bequeath and devise to my said wife my entire Estate, including lands, chattels, personal property, insurance accounts, claims,, chores in action and all property of every kind, character and description, to have and to hold for her sole use and benefit for during the term of her life, or until she marry again, in either of which events, such of my estate as shall at that time be inexistence, I will devise and bequeath as follows: One half interest [actually looks like 'share'] to my daughter Lois McPherson Clapp of if she shall have died previous to the death or marriage of my wife, then the one-half interest which she would have inherited if living shall go to the heirs of her body. the other half interest to the children or their bodily heirs of my deceased son, Webster B. McPherson. The property and estate of such children of the said Webster B. McPherson, deceased, as may be under the age of twenty-one years to be turned over to the First National Bank of Montgomery Alabama to be by it held and administered un the terms of a certain declaration of trust made by me in for of said Bank on the 16th day of April 1924 pertaining to certain trust funds for the use and benefit of said Children. In witness whereof – I have hereunto set my hand and seal on this the 16th day of April 1924 J. C. L. Adams. C. J. Pullen The State of Alabama } Probate Court Lowndes County } In the matter of the Probate of the last Will and Testament of Jno C. McPherson, deceased – Before me, W. H. Lee, Judge of Probate Court in and for the County and State aforesaid, personally appeared in open court – L. L. Adams, who having been by me first duly sworn and examined, did and does depose and say that C. J. Pullen and the said W. L. Adams are subscribing witnesses to the foregoing instrument of writing now shown to the said affiant and which purports to be the last will and testament of Jno. C. McPherson, Sr., since deceased late an inhabitant of Lowndes County. That the said Jno. C. McPherson, Sr. since deceased signed and executed the said instrument on the day the same bears date and declared the same to be his last will and testament and that affiant set his signature thereto on the day the same bears date as a subscribing witness to the same in the presence of said testator and at his request and in the presence of each other, and that said testator was of sound mind and disposing memory and understanding and in the opinion of affiant fully capable of making his said will at the time the same was made as aforesaid. And deponent further states that said testator was on the day of the date of said Will of the full age of twenty-one years and upward and a resident of this County. W. L. McPherson, Sr., deceased, and that said will, together with the proof thereof, has been recorded in my office in Book No. "D" of Wills, at page 308 – 9 – 10 -.
