Whitley of Letohatchie, Alabama, Lowndes County in the State of Alabama, being of sound and disposing mind do hereby make and publish this my last will and testament hereby revoking all former wills by me at any time heretofore made. First: I direct that my just debts be paid by my executors hereinafter named as soon after my death as may by them be found convenient. Second: I give, devise and bequeath unto my son, W. E. Whitley, all of my household furniture, goods wares and effects therein contained, and to the said W. E. Whitley, I also give devise and bequeath and undivided one third interest in my lot or parcel of land situated in Letohatchie, Alabama, together with my residence situated on said lot, described as follows: Bounded on the East by the Hayneville and Hickory Grove Road, on the North by the lot of the Baptist Church and lands of W. A. Broughton, deceased, on the West by lands of W. A. Broughton, deceased, and on the South by the remainder of the land owned by me and hereinafter conveyed to my sons, A. J. Jenkins and G. L. Jenkins. Third: I give devise and bequeath to my sons, A. J. Jenkins and G. L. Jenkins the following track of land known as the Jenkin’s Place, being West of Ft. Deposit in Lowndes County, Alabama, and more particularly described as the East Half of the S. W. ¼ of the N.W. ¼ of the N. W. ¼ of Sec 20. Also the S.E. ¼ of the N.W. ¼ of the N.E. ¼, West of Beaver Creek in Section 29, T. 12 R. 14. I also give, devise and bequeath to my said sons, A. J. Jenkins and G. L. Jenkins, each an undivided one third interest of my lot or lands situated in Letohatchie, Alabama, together with all houses and appurtenances thereunto belonging, the other undivided one third interest being given by this will to my son W. E. Whitley. Fourth: I do hereby nominate and appoint my sons, A. J. Jenkins, G. L. Jenkins, and W. E. Whitley to be the executors of this my last will and testament and I do hereby relieve them from giving bond or making an accounting to the Probate Court or any other Court except to probate this my last will and testament. It is hereby further directed that my said estate be settled out of Court and that should any disagreement arise between my three executors that the opinion of and wish of the majority of them shall govern and be final. In testimony whereof I, the said Georgia J. Whitley have to this my last will and testament subscribed my name and affixed my seal in the presence of the witnesses hereto, this the 4th day of January 1906. Georgia J. Whitley, in our presence and we in her presence and in the presence of each other at her request, and we each hereunto subscribe our names as witnesses on the day and the date of said will. C. A. Suggs J. H. Schuessaler The State of Alabama Lowndes County Probate Court In the matter of the probate of the last will and testament of Georgia J. Whitley, deceased. Before me, J. C. Wood, Judge of the probate Court in and for the county and State aforesaid personally appeared in open Court C. A. Suggs, who having been by me first duly sworn and examined did and does depose and say that himself and J. H. Schuessler were subscribing witnesses to the foregoing instrument of writing now shown to the said affiant and which purports to be the last will and testament of Georgia J. Whitley deceased, late an inhabitant of this county, that the said Georgia J. Whitley since deceased, signed and executed said instrument on the day same bears date, and declared the same to be her last will and testament and that affiant set his signature thereto on the day the same bears date as subscribing witness to the same, in the presence of the testatrix and at her request and in the presence of each other and that said testatrix was of sound mind and disposing memory and understanding, and in the opinion of the affiant fully capable of making her said will at the time the same was so made as aforesaid. And deponent further states that said testatrix was on the day of the date of said will of full age of twenty one years and upward and a resident of this county. C. A. Wood Judge of the probate Court in and for the county and State aforesaid, do hereby certify that the within instrument of writing has this day in said Court and before me as the Judge thereof, been duly proven by the testimony of C. A. Suggs, subscribing witness to be the genuine last will and testament of Georgia J. Whitley deceased, and that said will together with the proof thereof has been recorded in my office in Book Number D of Wills at page 66. In witness whereof, I have hereunto set my hand and affixed the seal of said probate Court on this the twenty fourth day of February A.D. one thousand nine hundred and eight. J. C. Wood. Judge of probate Court, Lowndes County, Ala. Additional Comments: Georgia Josephine Watson, daughter of Emsley Watson and Mary Ann Ellis, was born December 21, 1837 and died January 25, 1908. She married first Andrew Jackson Jenkins, born October 23, 1822, died January 07, 1864 and second William B. Whitley, born about 1830, died July 22, 1882, in 1873.
