DAVIS, WITNESS FOR PROBATE OF CHARLES P. CABANISS, DEC’D, INTESTATE, Huntsville, Madison County, Alabama Deposition of Drury M. DAVIS witness sworn and examined under and by virtue of a Commission issued out of the Probate Court of Madison County, Ala. In the matter of the Petition of S. D. CABINESS, admr. Of Chas P. CABINESS, acct. to sell real estate for distribution. The said Drury M. DAVIS being duly sworn to speak the truth, the whole truth, and nothing but the truth doth depose and say as follows: To the first Inty he says: ANS. 1: I do—He died without having been married. He left surviving him one brother, Septimus D. CABANISS, who is the administrator of his estate, and one sister, Mrs. Sarah A. H. WHITE, who has since died, leaving the following children surviving her to wit: Caroline C. WHITE, James C. WHITE, Louisa A. WHITE, Septimus C. WHITE, Susan, otherwise called Susannah, WELLBORN, wife of Elias WELLBORN & Chillion Q. WHITE, and the following grand children, who are children of her deceased daughter Virginia O. MARTIN, who died in her lifetime towit: Sally WHITSETT, wife of William WHITSETT, Lillian WINDHAM, wife of Eustace WINDHAM, Joseph MARTIN, Charles MARTIN, Virginia MARTIN, and Caroline MARTIN. Said Charles P. CABANISS also had two brothers, who died in his lifetime leaving children, namely William M. CABANISS, who left surviving him a daughter, Lucy SNEDICOR, who is the wife of Frank P. SNEDICOR. Alfred B. CABANISS who left six children surviving him—namely, Elizabeth, alias Bettie, CABANISS, William CABANISS, Lucy CABANISS, Alfred CABANISS, Chares and Susan CABANISS. He also had two sisters who died in his lifetime leaving descendants who are heirs at law of said intestate, to wit..Elizabeth H. TATE and Martha W. ALLEN. That the descendants of his said sister Elizabeth who survived him are as follows, to wit, one son John M. TATE, Charles TATE, the son of her deceased son A. C. TATE, also a son of her deceased son, Charles C. TATE, sometimes called Clem C. and sometimes called Charles TATE. Martine WILEY, daughter of her deceased daughter, Historia Wellborn, Alfred Wellborn, son of her deceased daughter, Mira WELLBORN, Elizabeth alias Betty CAPPS, Lucy MAYBERRY, and William B. WELLBORN, children of Lucy WELLBORN, a deceased daughter of the said Elizabeth H. TATE. That the descendants of the said Martha W. ALLEN, who are heirs at law of said intestate Charles P. CABANISS are as follow to wit: one son Drury M. ALLEN, four daughters, Caroline C. ALLEN, Sarah SMART, Araminta BLEDSOE, and Lucy A. W. DAVIS and four children of a deceased daughter of the said Martha W. ALLEN, Virginia TURMAN who died in the life time of the said Charles P. CABANISS and whose children are named Nancy TURMAN, Charles B. TURMAN, Martha C. ALLEN, and Mary W. TURMAN. To the 2nd Inty, he says: ANS 2.: I know the lands mentioned. To the 3rd Inty, he says: ANS 3: They Cannot. To the 4th Inty, he says: ANS 4: They Cannot. To the 5th Inty, he says: ANS 5: I think of nothing further that is deemed *undecipherable* D. M. DAVIS I, J. C. Green, one the of the Commissioners in said Commission named, do hereby certify that the evidence of the witness, Drury M. DAVIS, was taken down under oath, and subscribed by him in my presence, on the 19th day of August, 1882, at my office in Huntsville in the said County of Madison, State of Alabama and that I have personal knowledge of the personal identity of said witness, that he was sworn and examined as above stated and that his evidence was taken down in his own language, and was subscribed by him in my presence, and that I am not of kin, or counsel for either party to their cause, nor in any way interested in the result thereof.
