ALGenWeb File Manager - Lygia Dawkins Cutts ----------------------------------------------------------------------- In the name of God Amen: Know all men by these presents that I, Samuel Green of Owens Cross Roads in the State of Alabama, being of sound mind and memory do make and publish this my last will and testament, hereby revoking all former wills by me at any time heretofore made. As to my worldly estate and all real personal of mixed property of which I shall be seized and possessed or to which I may be entitled at the time of my decease, I devise and dispose thereof in the manner following, towit: FIRST my will is that all my just debts and funeral expenses shall by my executor hereinafter named be paid out of my estate as soon after my decease as convenient. SECOND I give and bequeath to my beloved wife Ellen Webster, all on my household furniture and other personal property that I may own at the time of my death. I also give her to have and to hold during her natural life, but to become the property of my beloved son Milas Johnson Green, at her death, the following described real estate, all situated in Madison County, Alabama: the east half of the northeast quarter of section twenty four in township five, of range one east also the northeast quarter of the northeast quarter of said section twenty four, range one east containing seventy acres more or less and known as the Egbert Jones Place, whether this land above bequeathed be properly described or not: also the southwest half of the southwest quarter and the southeeast half of the southwest quarter, of section 14 township five range one east, containing 80 acres more or less, being my homestead and known as the John Hunt and William Ellett lands: also the northeast quarter of the northeast quarter of section 22, township five range one east, containing forty acres more or less and known as the J. V. Ellett property: also the southeast half of the southeast quarter of section 15 township five range one east containing 40 acres more or less and known as the Hickman property: also the northeast part of fractional section twenty three, township five range one east, containing 56 acres more or less and known as the McGaha property. It is my will that all of the above described real estate go to my son Milas Johnson Green at the death of my wife Ellen Webster and should he died before my wife Ellen Webster shall depart life, it is my will that all of the above described real estate and personal property, shall go to the heirs of my son Milas Johnson Green. It is my will that at the death of my wife that all the personal property including mules, cattles, hogs or other stock farming implements such as wagons, plows, cultivators & etc. that my wife shall become possessed of at the time of her death, that she has derived from me at my death, go and become the property of my son Milas Johnson Green. THIRD Should my wife Ellen Webster die before I shall depart this life it is my will and I give devise and bequeath to my beloved son Milas Johnson Green the following described real estate, all situated in Madison County, State of Alabama, described as follows: {SAME AS LISTED ABOVE} FOURTH I give, devise and bequeath to my son Milas John Green, the following property, two steam engines, two steam boilers, one grist mill, one saw mill, and one set of blacksmith tools. FIFTH I give and devise and bequeath all my remaining real estate to my beloved children and heirs as follows: and each are to share equally in the division of the property and the children of my daughter Sarah Glover, Emily Buford and my son Samuel Green shall share equally with Mary Dixon, Martha McGaha, Rebecca Glover, Jane Clarkson, Lucinda Buford, Biddie Austin, each dead childs children receiving for their part, only a childs or equal part all the remaining estate shall be sold for division. SIXTH I do nominate and appoint my son Milas Johnson Green and my good friend and legal counselor David A. Grayson, to be the executor of this my last will and testament and it is my will that they serve without bond. In testimony whereof, I the said Samuel Green, have to this my last will and testament subscribed my name and affixed my seal this 27th day December, 1899.
