It appearing to the court that citations had been regularly served upon the heirs and legatees and that Wells Thompson a now resident of this state by letter addressed to the clerk of this court had waived the priviledge of notice by meand of publication in a newspaper and acknowledged himself legally notified of said petition. Darwin S P Thompson having this day appeared in open court and waived the ___ citation and consents that the decree for sale be made according to the prayer of petitioner. It is therefore ordered and decreed that Joseph McDowall, Benjamin Glover and Thomas Buford be appointed commissioners to sell the land specified in the petition theretofore ___ upon the record. Upon a credit till the 1st of January next 1839 for one half of the purchase money and for the other half on a credit till the 1st of January 1840 and that notice be given as the law directs and report be made by said commissioners at a regular term of this court to be held on the 1st Monday in May next.
