AL Page 113 Estate of Thomas M Thompson, Dec’d In this case the term of office of N B Lesurn late sheriff of Marengo County and administrator of said estate, having expired. Now this day came John F Thompson and applied for letters of administration upon the estate of said intestate and the said John F having entered into bond in the sum of five thousand dollars with John Varner and T. B. Thompson as sureties and qualified as administrator of said estate. It is ordered by the court that said bond be approved and recorded and that letters of administration be granted to said John F Thompson accordingly. And it is further ordered that W B Jackson, C B Lowng and J H Ayres be appointed appraisers of said estate. And on application of said administrator it is further ordered that he be authorized to ship and sell the crop of cotton of 1856 for cash at private sale and also to sell the perishable property at auction on a credit of 12 months and it is further ordered that he be authorized to hire at public or private hearing the slaves belonging to said estate by the month rental a certain ___ now pending against said estate in the circuit court of Marengo County be determined. Ja’s A Young Judge Page 357 Probate Court Marengo County September Term AD 1857 Estate of Thomas M Thompson, Dec’d On the application of John F Thompson, adm. It is ordered by the court that S H Ayres, Sterling Hylton and James A Gamble be appointed appraisers of the personal property of said estate. Estate of Thomas M Thompson, Dec’d This day came John F Thompson and filed his petition for an order to sell the slaves belonging to the said estate for the purpose of distribution. It is therefore ordered that said petition be set for hearing on the 2nd Monday in October next and that notice thereof be given by publication for 3 successive weeks in the Linden Jeffersonian. Probate Court Marengo County October Term AD 1857 Estate of Thomas M Thompson, Dec’d This day came on to be heard the petition of Thomas M Thompson adm. Of said estate for an order to sell the slaves of said ___ ___ for the purpose of making distribution among the heirs at law and it appears that notice of the time and place of hearing said petition has been given by publication for 3 successive weeks in the Linden Jeffersonian and there being no objection to the granting said petition. It is therefore ordered by the court that said administrator be authorized to sell said slaves at public auction before the courthouse in Linden in said county on 12 months credit from the day of sale after duly advertising the time place and terms of sale as the law directs and make report thereof at the January term of this court next. Probate Court November 11th 1857 Estate of Caroline T Thompson, minor This day came T B Thompson and applied for letters of guardianship upon the estate of Caroline T Thompson, a minor residing in Marengo County. And the said T B Thompson having entered into bond on two thousand dollars with J B Lacey and Sam’l E Chapman as sureties and qualified as such guardian. It is ordered by the court that said bond be approved and recorded and that letters of guardianship be granted to said T B Thompson accordingly. Estate of Thomas M Thompson On the application of John F Thompson, it is ordered by the court that the partial settlement of said estate be continued to the 4th Monday of November instant. November AD 1857 As a term of the probate court held for Marengo County on the fourth Monday and 23rd day of November AD 1857. Hon J A Young presiding the following proceedings were had and orders made to wit. Estate of Thomas M Thompson, Dec’d This day came John F Thompson administrator of the estate of Thomas M Thompson Dec’d by attorney and likewise came Lewis Wren and wife, Dixon L Turner and wife and Thomas B Thompson heirs of the said intestate in their proper persons. And also came Caroline Thompson, minor, by T B Thompson her legal guardian, who now here in open court accepts the appointment of guardian ad litem and consents to appear as such. And the account and vouchers of said John F Thompson as administrator aforesaid for partial settlement of said estate being heard and stated. It appears to the satisfaction of the court that notice of the time and place of said settlement has been given by the publication in the Linden Jeffersonian for 3 successive weeks. It further appears that after charging said administrator with all where with he is chargeable and allowing him all proper credits then remains in his hands a balance of 4 thousand and 36 dollars and 2 cents to be distributed to the heirs at law of said Thomas M Thompson. It is therefore adjudged, ordered and decreed that said account as stated be allowed and recorded as a partial settlement of said estate. And it is further ordered and decreed that said John F Thompson adm’n aforesaid distribute and pay out said balance of 4036.02 dollars to the heirs of said intestate as follows. To wit, to said T B Thompson the sum of 576.57 dollars. To said Lewis Wren and wife to the separate use his wife Sarah W Wren the like sum of 576.57 dollars. To said Dixon L Turner and wife to the separate use of his wife Margaret M the like sum of 576.57 dollars. To Caroline Thompson the like sum of 576.57 dollars. To Reiser D Gray and his wife Mary E to the separate use of said Mary E the like sum of 576.57 dollars. And to Rowell Boykin and his wife Letitia N to the separate use of said Letitia the like sum of 576.57 dollars. And that ___ said John F Thompson retain the like sum of 576.57 dollars. And now here in open court the said John F Thompson pays over to the aforesaid T B Thompson his distributive share aforesaid in full. And also pays to said Lewis Wren a trustee for his said wife her distributive share aforesaid. And to said Dixon L Turner as trustee for his wife aforesaid her said distributive share and to said T B Thompson as guardian of said Caroline Thompson her said distributive share in full. The several ___ for which are now here filed and acknowledged by the parties in open court. It is therefore ordered and decreed that satisfaction be entered in full of the amount herein discussed to said Thomas B Thompson, Lewis Wren and wife, Dixon L Turner and wife and Caroline Thompson. And the said John F Thompson now here tenders to the court the amount decreed to said Reizer D Gray and wife and to said Rowell Boykin and wife which tender is refused by the court. November 23 1857 Page 399 John F Thompson and others VS Caroline Thompson and others This day came John F Thompson and others and filed their petition for an order to sell certain slaves therein mentioned owned jointly by them with Caroline Thompson a minor and others for the purpose of making distribution ___ said joint owners. It is therefore ordered by the court that said petition be set for hearing on the 23rd day of December and that citation issue to the said Caroline Thompson and it is further ordered that publication be made for 3 successive weeks in the Linden Jeffersonian for the non resident joint owners to appear and contest said petition if the think proper. Ja’s A Young, Judge Page 405 Probate Court Special Term held December the 3rd 1857 Estate of Thomas M Thompson This day came John F Thompson and filed in court the receipt of Rowell Boykin for the sum of 576.57 dollars being in full of the decree in favor of said Boykin and wife to the use of the wife rendered as the ___ of this ___ held the 25th day of November 1857.
