All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/al/alfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Virginia Crilley http://www.genrecords.net/emailregistry/vols/00003.html#0000642 January 18, 2018, 5:05 pm Written: 1826 Deed of Gift from Joshua Hightower to Charnell Hightower Marengo Co Alabama Deed Book A pg 266 Feb 1, 1826 Recorded 1st day of Feb 1826 Know all men by these presents that I Joshua Hightower of the state of Alabama and Marengo County aforesaid for and in consideration of the natural love and affection which I have for and bear towards my grandson Charnell Hightower of Walton County in the state of Georgia and also for and in consideration of the sum of one dollar to me the said Joshua Hightower in hand paid and of the conditions hereafter expressed accepted and agree to the said Charnell Hightower before the signing, sealing and delivery of these presents the receipt of the said sum of one dollar is hereby acknowledged have given granted delivered and confirmed and by these presents do grant deliver and confirm unto my said grandson a certain Mulatto man slave named Frank aged about twenty eight years to have and to hold to the only proper use and benefit and behoof of the said Charnell Hightower his heirs Executors Administrators and assigns forever. The foregoing gift and conveyance subject nevertheless to the following conditions to wit. First that the said Joshua Hightower is to have and retain to himself the possession and use and to have the profit and benefit of the labor and service of the aforesaid Mulatto man slave {Frank] for and during the natural lifetime of the said Joshua Hightower and secondly the said Charnell Hightower accepts of the aforesaid slave and the foregoing conveyance and conditions as his full proportions and shares any and all Estates which have descended to him the said Charnell by the death of Thomas Hightower his Father and also for any and all Estates which may heretofore descend to said Charnell by and at the death of the said Joshua Hightower and the said Joshua Hightower and the said Joshua Hightower for himself his heirs executors administrators doth farther covenant and agree that said Charnell from and after the death of said Joshua shall have hold use and possess the said slave Frank peaceably free and clear against the claim or claims of all persons whatsoever. In witness whereof the said Joshua Hightower has hereto set his hand and seal at Linden this fourth day of Feb A.D. 1826. Joshua Hightower Witness: John C. Jones. SS Be it remembered that on the 4th day of February A.D. 1826 personally appeared before me the undersigned Judge of the County Court of the said County of Marengo the witness named Joshua Hightower who acknowledged that he signed sealed and delivered the foregoing deed to the said Charnell Hightower on the day and year herein mentioned given under my hand and seal as appears the day and year aforesaid.
