I give and divise unto my son Wells A Thompson 3000.00 dollars to be at his absolute will and control without any restriction or lamentation whatever. I give and divise unto my daughter Isaphorna/Isapahana Bassett during her life for her sale and separate use exclusively of her husband who is not to intermediate there with nor is the same or any part thereof to be viable or subject to such husbands control, debts or engagements one thousand dollars remainder to her children and if she die without children then the remainder to any of my children or grandchildren to whom she may be will divise the same and if my said daughter should die without children or without leaving a will then the remainder to be divided equally among my children and their representatives of such as one deceased the representatives taking equally their ancestors part. I give and divise all my household furniture to my sons Elbert A Thompson, Darvin or Darwin Thompson and Wells Thompson to be divided equally amongst them. The remainder of my estate both real and personal I give and devise to be divided equally among my sons Wells A, Elbert A and Darvin, my daughter Louisiana wife of Robert Manning. Indiana, wife of James Manning Junior and my daughter in law Nancy wife of my son Asa W Thompson in manner and form following that is to say. To Wells A I give and divise his portion of said remainder absolutely without any limitation or restriction whatever. To Elbert A and Darvin I give and bequeath them respective portions of said remainder to them for their use and benefit during their lives remainder or to their children and if they should die without children to whom they by will may divise the same and if they should die without children and with out leaving a will then the remainder to be divided equally among my children and the representatives of such as one deceased the representatives taking equally the portion their ancestors would be entitled to. To my daughter Louisiana and Indiana and my daughter in law Nancy I give and divise their respective portions of said remainder to them during their lives for their sale and separate use and benefit exclusively of their husbands who are not to intermediate there with nor is the same of any part thereof to be subject to or liable to their husbands control, debts or engagements remainder or to their children and if they should die without children remainder to such of my children or grandchildren to whom they by will may divise the same and if they should die without children and without leaving a will then the remainder are to be divided equally among my children and the representatives of such as are deceased the representatives taking the portion of their ancestors. It is my will and desire that if my estate both real and personal should not be sufficient after discharging all my debts to pay and satisfy the legacies aforesaid that they shall not abate proportionally. In legacy first mentioned shall be first satisfied and so on until my estate is ___. I do hereby constitute and appoint my friends Bently M Laur and George P B___ executors of this my last will and testament hereby revoking all other former wills or testaments by me heretofore made. In witness whereof I have hereunto set my hand and affixed my seal this 22nd day of July 1835. The executor of the last will and testament of Polly Thompson late of said county deceased having this day been duly proven by the oaths of Thomas Fearn, James Manning and George F Manning the then subscribing witnesses thereto is ordered to the record (_.B.7 page 22 ___) I Richard B Pendom clerk of the county court of Madison county in the state of Alabama certify that the above and foregoing contains a true copy and complete transcript of the last will and testament of Polly Thompson deceased together with the probate thereof ___. In testimony whereof I hereto subscribe my name and affix the seal of said county court at office in Huntsville this 29th day of June AD 1837 and of American Independence the 61st Rich'd B Pendom Estate of Polly Thompson Dec'd This day appeared Benjamin Taliaferro and presented the last will and testament of Polly Thompson deceased certified according to law by Richard B Purdom clerk of the county court of Madison county in which court doing the business of an orphan court the said last will had been previously duly proved by the subscribing witnesses thereto and recorded. Whereupon it is considered and ordered by this court that the said certificate copy of the last will and testament of Polly Thompson deceased be recorded in the office of the clerk or register in this court. And the said Benjamin Taliaferro having entered into an administration bond according to law with John Schirin and John Masterson as his securities thereon and which bond is approved of by the presiding judge and having also taken the oath prescribed by law for the due performance of his duties. He the said Benjamin Taliaferro is appointed and constituted administrator with the will annexed of all and singular the goods and chattels rights and credits still unadministered which were of the said Polly Thompson deceased at the time of death and letters of administration are accordingly granted.
