We understand that an atrocious murder was committed at a place called Short Creek, on the Sand Mountain, in Marshall County. The circumstances as detailed to us are these:--A man by the name of John Smith was indebted to an old man for work, and in settling Smith fell out with him, and beat him unmercifully—cracked his head with a hoe. Smith left him, under the impression that he had killed him. Smith’s son, after a while seeing the old man was about to recover, went and beat the old man again, and left him for dead. He however recovered, and procured process against the Smiths, and the officer, apprehending danger from Smith, who it is said, is reckless and unprincipled, summoned a man by the name of George Berry to assist. Berry, as soon as he arrived at the house entered it and Smith snapped his gun at him. Berry immediately took hold of Smith and while engaged, Smith drew a pistol and shot Berry through the head—he fell dead. While the rest were fastening Smith to carry him off, Smith’s wife knocked down one of the company with an andiron, and snapped a gun at the whole crowd. Smith is in jail at Warrenton.— Gladiator, (Ala.)
