I John Fincher being of sound mind but seriously affected in my body do hereby make this my last Will and Testament as follows: First, I bequeath my body to God who made it firmly trusting in the meritorious sacrifice of my Redeemer to save my soul; Next, as to the worldly property I hold I dispose of it as herein after mentioned. I do hereby Will and devise the house and lot on which I now live to my beloved wife Mary Fincher together with all my household furniture and whatever other articles may remain on the premises at the time of my decease together with all moneys, notes of hand, book debts or specialty belonging to me. Next, I devise and bequeath to my children William, Sarah Ann, Emma, and Josephine all my right title and interest in the property whether lands, houses, money or other goods which may be coming to me out of my father William Fincher's Estate or of that of my brother William Fincher to be equally divided among them as they shall respectively become of age provided always that the child with which my said wife Mary is now pregnant shall be born quick and survive that then he or she shall become [joint/point legater] with the other children and divide an equal portion with them of the property so bequeathed. Lastly, I do give and bequeath to my sister in law wife of Horace Tally all that lot of land with the building and appurtenances thereon and belonging on which he now resides and which was part of the land held by my late father in law Willie Tally together with the land adjoining and which has been considered as belonging Ann Fairly also being a portion of the aforesaid land of Willis Tally. Sullivan the two subscribing witnesses hereto that I recognize and acknowledge Serena Ethel Oswald, a minor girl of the age of seven years, born on November 10th, 1946 in Mobile, Mobile County, Alabama, as my child and capable of inheriting my estate, real, and personal, as if born in wedlock. And it is my desire that the name of said child be changed from Serena Ethyl Oswald to Serena Ethyl Fincher; that Hiram Fincher and Mary Elizabeth Oswald subsequently married.
