George KILO, dec'd Estate of This day came Rebecca HETHERINGTON, one of the legatees mentioned in the will of George KILO, dec'd, by her attorney; S. J. CUMMING, Esq. & filed her application in writing, & under oath, praying that her legacy under said will may be delivered to her - that as such legatee, she is entitled to one third part of the following named negroes, Jones, a negro woman & her four children; Peter, Adam, Ellen, & Margaret: Nancy, & her four children; Milley, Prince, Wiley & Nelson: Bowman a man: Sily[?] a woman: Ann, Nathan and Rachel, that said negroes are enumerated in the Inventory of said Estate, now on file in this Court - that said estate is solvent & that it is now, more than eighteen months, since letters testamentary upon said will, were granted & issued to Hannah KILO, as Executrix of said will. It is therefore, ordered, that the second Monday of Nov. next be appointed a day to hear said application, and that citations issue, to be personally served on said Hannah KILO, as Executrix of said will at court ten days before the said day of hearing. It's further ordered that notice of this application & of the day above set for hearing the same be given to John THOMPSON, Alex S. THOMPSON, Geo. K. THOMPSON, Jas. THOMPSON, Charnie BRANTLEY & Mary BRANTLEY his wife all of whom are of full age, & reside in Conecuh County, Ala. Also to Wm. THOMPSON, Stephen ADAMS & Jane ADAMS, his wife, who are of full age & reside in Lowndes County, Alabama by citation to be personally served on each one by copy- and it appearing to the Court, from an inspection of said application, that John A COWEN, Jane COWEN, Martha CREIGHTON and her husband, Ely CREIGHTON, Rebecca A. ADAMS & her husband, Wm. ADAMS, legatees named in said will of Geo. KILO dec'd. are non-residents of the State of Ala. And all of full age. It's therefore ordered that notice of this application & of the day set for hearing the same be given by publication for thirty days in the Southern Champion, a newspaper published in this County, that all persons in interest may appoint & contest said application if they think proper. Citation having been given to Hannah KILO, the executrix; to John THOMPSON; Alexander S. THOMPSON; George K. THOMPSON; James THOMPSON; Mary BRANTLEY, wife of Charnie BRANTLEY; William THOMPSON; and Jane ADAMS, wife of Stephen ADAMS who it appears are the lineal descendants of Jane THOMPSON, named in the will. Notices have been given to John A. COWEN; Jane COWEN; Martha CREIGHTON, wife of Eli CREIGHTON; and Rebecca A. ADAMS, wife of William ADAMS. By the terms of said will, the slaves, Jones, a negro woman & her children Peter, Adam, Elleck & Margaret; Nancy & her 4 children Milly, Prince,, Wiley & Nelson; Bowman, a man; Sill, a woman; Ann; Nathan & Rachel are bequeathed to the lineal descendants of the testator's brother John, his sister Margaret COWEN & his sister Jane THOMPSON. Said application granted as to the said Negroes, Bowman, Sill, Ann, Nathan & Rachel but refused as to the other are involved in a suit now pending in the Chancery Court at Claiborne, Al. Divide Negroes: 1/3 to Rebecca HETHERINGTON; 1/3 to descendants of Margaret COWEN; 1/3 to descendants of Jane THOMPSON. Probate Court, Special Term, 19 Nov 1860. Above Negroes ordered sold at public outcry on Monday, 31st day of Dec. 1860.
