We found upon examiniation that Joseph Booth was interested with his brother William Boothe dec. in the purchase of the land of which it was proposed. The said William decd seized of an undivided one third part - But the parties interested being all present consented personally and by Guardian that the undersigned commissioners should adopt the following course: we proceeded to value the said lands as follows: to wit: NW1/4 of 35 T.6 R.5 valued at $8 per acre and alloted to M. McRae in right of his wife, formerly Elizabeth Booth- NE1/4 of 35 T.6 R.5- valued at $9 per acre and alloted to Jesse Odom in right of his wife formerly Nancy Boothe- NW of 2. T.5 R.5 valued at $3.50 per acre and allotted to Joseph Boothe - SW1/4 of 35 T.6 R.5 valued at $5.00 per acre allotted to J. Booth- The 1/2 of 1/4 of 35, T.6, R5 valued at $9.00 per acre & allotted to J. Booth- The 1/2 of 1/4 of 2 T.5 R.5 valued at $2.00 per acre and allotted to J. Booth. We found the amount of the aforesaid valuation after deducting what is still due to the land office on the purchase of said lands to be $3758.35 From which we deducted 1/3 for J. Booth share in said land as an original purchaser...........................1252.78 Leaving a balance of .......................$2505.57 Which we divided into five equal shares Jas. Boothe $ 501.11 McRae's 501.11 Jesse Odom's 501.11 Wm Brown's 501.11 Laura Booth 501.11 Jesse Odom will have to pay to Mr. Brown in right of his wife Martha to L. Booth & Joseph Booth the sum of $795.52 - the amount recd by him more than his share in the Land- and McRae will have to pay to the aforesaid persons the sum of $536.02 The amt. recd by him more than his share of the Land making $1331.54 to be paid by Odom & McRae which must be divided as follows towit To Mr. Brown in right of his wife Martha Boothe}$501.11 To. L. Boothe} 501.11 To Jos. Booth} 389.32 We found it impossible to make division of the aforesaid land amongst all the heirs without doing manifest injury to one or more of them- And this mode of affecting the Division being recommended and assented to by all the Partees interested, we recommend to the Court to adopt this report - as the best arrangement for all concerned that can be made. Sally 250 ___ 750 Lot No. 5 To Joseph Booth Mariah 300 Phebe 250 ___ 550 We do Certify the following to be a true Division of the part of the estate of William Booth decd so far of respects the Negroes made by us 2 Feb 1821 John F. Lovett W. C. Vaughn John Davis State of Alabama Monroe County} Personally appeared before me Gurdson Robinson a Justice of the Peace for said County~ John F. Lovett, Wm C. Vaughn and John Davis - and made oath that they would faithfully, justly & impartially make a division of the estate of the late Wm Booth decd - Between the lawful Heirs of said Estate. Sworn to before me this 25th day of December 1820 John F. Lovett W.C. Vaughn John Davis Ordered by the Court that Daniel McDaniel & Joseph Boothe be permitted to sell the personal property of the late Wm Boothe- Also that he be permitted to sell the crop when gathered, on giving the notice required by Law. Also that Joseph Boothe be appointed guardian to Laura Boothe a miner under Fourteen years in the sum of Five thousand Dollars ordered. Also, Ordered that Danl. McDaniel be approved of as his security. Ordered also that the adms. of Wm Booth be permitted to make a division of the Est. of said Booth among his heirs, agreeable to Law & that John F. Lovett, Wm C. Vaughn and John Davis be appointed to make partition of said Estate~
