This file is copyrighted and contributed by: Ruth Newlan ==================================================================== March 2003 Whereas by Gods permission a marriage is shortly intended to be solemnized between Polly Oliver of the County of Monroe and State of Alabama and Martin James of the same County and State ~ And it is by these presents agreed by and between the said Polly Oliver and the said Martin James that all the property which the said Polly Oliver now has in her own right and all the property real and personal which she may be entitled to from the estate of her late husband William Jones decd and all the property real & personal which may hereafter fall to her or to which she may be entitled from any source shall be and remain the bona fide property of the said Polly during her natural like subject to her own direction will and control and free from the management direction will and control of the said Martin James and at the death of the said Polly the said property so secured to her during her natural life shall descend to and pass over to her infant son James Cornell Oliver. And it is further agreed that the said Polly shall be at liberty at any time to give transfer and pass over to her said son on his arriving at the age of twenty one years or sooner if she think proper any part or portions of the property secured to her during her life or to which she may be entitled all which she may do without the consent or approbation of the said Martin James. And it is further agreed that should the said James Cornell Oliver depart this life without issue living at the time of his death that then the property above secured to the mother and the said James Cornell Oliver by this agreement shall be equally divided between the other children of the said Polly Oliver. And it is further agreed that the said Polly Oliver shall at all times during her intended overture with the said Martin James apply the proceeds of her property secured to her as above as she may think proper- and the same is not to be filed or applied by the said Martin James. And it is further agreed that the said Polly Oliver the said James Cornell Oliver and any other person entitled under this agreement may from time to time as occasion may render proper apply to the court of Equity for the appointment of a Trustee and the enforcement of this agreement as In witness whereof the said Polly Oliver and the said Martin James have this day set their hands and affixed their seals.
