It is therefore ordered, that the third Monday of Dec. next be appointed for hearing said Petition; and it appearing that two of the heirs of said Estate, to wit: Seaborne Lambert & Matthew Lambert are non residents of the State of Alabama. It is ordered, that publication be made in the Claiborne Southerner, at least forty days before said day of hearing, so that all persons interested may appear & contest said Petition, if they think proper - It is further ordered that Harvey M. Lambert, Jas. R. Lambert, Jno. D. Lambert, Isaac Thompson & Emily, his wife, E. N. Boykin & Mary, his wife, have notice of this proceeding by citations to be personally served on them. Probate Court, Special Term Dec. 21, 1863 Abigail Lambert, dec'd Estate of } This day came Alex. Lambert, the admin of said Estate, the same having been appointed for hearing his Petition for a sale of the Real & personal property of said Estate.- And the notice required by a previous order of Court having been given to all parties in interest, by publication in the Claiborne Southerner, a newspaper published in this County & by citation personally served upon all the resident heirs of said Estate- and it appearing to the satisfaction of the Court, from the written testimony of Jas. Daniel & Joel Bullard, taken as in Chancery cases & which is filed in this Court, that the land described as follows to wit: The S ½ of the S.W.1/4 of Sec 2, T. 6, R.5, in Monroe County, cannot be divided fairly & equitably, without a sale thereof - and if appearing to the satisfaction of the Court from the evidence submitted, that the personal property, consisting of slaves & other effects, cannot be fairly & equitably divided among the heirs & distributes of said Estate without a sale of the same. It is therefore ordered, adjudged & decreed, that said Petition be granted and that said adm's proceed & sell the above described land & all the personal property of said Estate including the slaves for the purpose of division, after having first given three weeks notice of said sale by publication in the Claiborne Southerner, a newspaper published in this County, & otherwise conducting the same in all respects as required by law - Terms of said sale, twelve months credit, with notes bearing interest from date, or cash at the option of the purchaser - It is further ordered, that said Petition be recorded for future reference~
