B, P. 58 Written: November 30, 1840 Recorded: January 28, 1842 1842 January 28 Will of Owen Dailey In the Name of God Amen Know all men by these presents that I Owen Dailey of the state of Alabama and county of Monroe hath this the thirtieth day of November in the year of our Lord one thousand eight hundred and forty. being sound mind memory, hath made and declared this instrument to be and contain my last will and testament in maner and form as follows vz Item 1st) I give and bequeath to my beloved wife Elizabeth Daily after paying my Just debts and funeral expenses all my estate both real and personal during her natural life time. Item 2nd) I give and bequeath unto my son John Dailey two hundred and forty five[?] dollars which he hath had Item 3rd) I give and bequeath unto my son Michael Dailey two hundred and thirty dollars which he hath had - Item 4th) I give and bequeath unto my son David Dailey two hundred and thirty dollars which he hath had - Item 5th) I give and bequeath unto my Daughter Barbary Dailey one servant girl Silvey or three hundred dollars which they[?] have had - Item 6th) And after deducting from the above described heirs the amount designated in the different Items above described - Then all my estate both real and personal to be equally divided in Equal Shares between my sons John Dailey, David Dailey, Michael Dailey, William Dailey, Adam Dailey, Jacob Dailey and to my Daughter Barbary Dailey and the legal heirs of George Dailey decd. all in equal and Co-Equal shares. Item 7th) I hereby appoint my beloved sons John Dailey & David Dailey Executors to this my last will and testament. signed sealed and acknowledged} Owen (his) D (mark) Dailey {seal} in presents of us Test.
