This file is copyrighted and contributed by: Ruth Newlan ==================================================================== March 2003 The Will of John Newman of Monroe County, AL I John Newman of Monroe County and State of Alabama being sick but of sound and deposing mind, memory and understanding do make and publish this my last Will and Testament hereby revoking and making void all former Wills by me at any time heretofore made. First - I do hereby nominate constitute and appoint my friends John W. Moore and Arthur P. Bagby Executors of this my Last will and Testament. Second - I do give devise and bequeath that fraction of land known as Fraction thirty three (33) East of the Alabama River Township Six (6) Range five (5) be sold and the proceeds of such sale de divided equally between the four oldest children of Peter Randon. Thirdly - I further devise and bequeath that the three Quarter sections of land in which I am possessed known as land in Section Thirty-four (34) Township Six (6) Range five (5) and the half Quarter Section being the west half of South west Quarter of Section Twenty Six (26) Township six (6) Range five (5) be sold and the proceeds be divided into four equal parts one part to be given to my Brother Thomas Newman one part to be given to my relatives the children of the Late John Fryer one part to Sarah Ann Miles daughter of Eliza and Philip Miles one part to my Executors John W. Moore and Arthur P. Bagby. Fourthly - I devise that a claim I hold against John Fryer for 4500$ when he obtains a Legal and complete Title to Fraction thirty three (33) West of the Alabama Township six (6) Range five (5) be given to the four oldest children of Peter Randon. Fifthly - I give and bequeath to John Fryer and Adam Carson two half Quarter Sections of land to wit the South half of Southeast and Southwest Quarters of Section twenty one (21) Township Six (6) Range five (5) on the condition that they pay a bond held by DR W. MRae against me for one Thousand dollars and also pay to my Executors five hundred Dollars. Sixthly- My stock of cattle Hogs Horses and mules consisting of about forty head of cattle marked with a swallow fork and uper bit in each ear forty head of hogs in same mark one bay mare one mule one year old filly I give to my Brother Thomas Newman Sarah Ann Miles and the children of the Late John Fryer. Sevethly - I give and bequeath to my brother Alger Newman one bay mare (named Star) and to my sister Susan one Roan Filly I further desire as my Last Will that my Executor as above named be authorisid and have full power to sell the above described Lands that they may be enabled to make the distribution as above desired in this my Last Will the interlinging of the Second third and fourth lines made before signing. In Wsitness whereof I the said John Newman have hereunto set my hand and seal this ninth day of April one Thousand eight hundred and thirty seven J. A. Newman deceased who having been first duly sworn depose and say the foregoing is the last will and testament of the said John A. Newman deceased so far as they knew or believed that they saw the said John A. Newman sign seal publish and declare the same as his last Will and Testament that he signed it in their presence and that they signed the same as subscribing witnesses in the presence of the Testator and at his request that they saw the other subscribing witness sign his name thereto and that at the time of signing that same the said Testator was of Sound and disposing mind.
