This file is copyrighted and contributed by: Ruth Newlan ==================================================================== March 2003 In the name of God amen.....I James Dellet Senior of the county of Monroe and State of Alabama being weak in body but of sound and perfect desposinly mind and memory blessed be almight God for the same do make and publish this my last will and Testament in manner and form followingly that is to say I give and bequeath to my son James Dellet one negro man named Tom Martin one negro boy named Aaron one negro gal named Maria, one negro girl named Elsey, and I do hereby acknowledge and confirm a deed of Gift executed by me to my son James of two negro men named Daniel and Sam to have and to hold the said negroes to him and his heirs forever. I give and bequeath to my beloved wife Mary Dellet one third part of all my Estate which shall remain after deducting the above named special bequests to my son James to have hold and enjoy the same for and during the term of her natural life or until the day of her marriage and in case of her marriage or death then my willl and desire is that the property so bequeathed to her as above mentioned shall be equally divided between my children John, Charles, Dellet and Leah Rachel Dellet~ 3rd - I give and bequeath to my son John Charles Dellet & to my daughter Leah Rachel Dellet - the remaining two thirds of my Estate to be equally divided between them should my son John die before marriage or without wife or issue living at the time of his death then the portion bequeath to him is to be equally divided between my son James and my daughter Leah and my will and desire further is that should my daughter Leah die without issue then and in that case the portion bequeathed to her is to go to my sons James & John and if either be dead then to the survivor to have to hold the same to them or him and to them or his heirs forever and my will and desire further is that my Executors use all due diligence in collecting all monies that may be due and owing to me and out of the same to pay and discharges all my just debts - To my son James I commit the care & management of my two children John & Leah and request that he will make use of the means placed in his hands in giving them as good an education as their circumstances and the opportunities of learning will afford and I do nominate constitute & appoint my son James Dellet John Murphy and W.W. McConico Executors of this my last will and testament.
