Davis, et al } This day came the said John T. Davis, Eliza S. Smith & Charles Gerald, & filed their Petition in writing, setting forth that they reside in Wilcox County, Ala., and that they, together with Nathan G. Davis, a minor under the age of 14 years, residing with his mother, Mrs. Nancy E. Davis, in Wilcox County, Ala. & Henry H. Hybart a minor over the age of 14 years & resides with his father Wm. L. Hybart, in Monroe County, Ala., are the only heirs & distributes of the Estate of John P. Davis, late of Wilcox County, Ala. - That they are joint owners of certain real estate situated in this County, which is portuntively described in said Petition, & which belongs to the estate of the said John P. Davis decd- and praying for an order & proceeding, have notice, as required by the Statute in such cases - It is further ordered, that John Deloach be & he is hereby appointed Gdn ad Litem for Nathan G. Davis and Henry H. Hybart, minors interested this proceeding & that he have notice of such appointment - John T. Davis et al } Petition of } This day having been appointed move Petition or application for a partition or division, of the following described lands to wit: SW1/4 of SW1/4 of Sec 2, E1/2 of NE1/4 of Sec 3; NE1/4 of NE1/4 of Sec 7; all of Sec 9; W1/2 of SE1/4 of Sec 4; S1/2 of SE1/4 of Sec 8; NW1/4 of Sec 10; NE1/4 of SW1/4 of Sec 10; NE1/4 of NE1/4 of Sec 17; all in T.8, R.7, containing in all 1680 acres, equally among the following named persons, as joint owners of said lands, towit: John T. Davis, Eliza S. Smith; Charles Gerald in right of his wife, Mary A. Gerald, all of Wilcox County, Ala. - Also, Mathew G. Davis, a minor, who resides with his Mother, Mrs. Nancy E. Davis in Wilcox County & Henry Hybart, a minor, who resides with his father Wm. L. Hybart in Monroe Co., Ala - And the notice required by a previous order of Court having been given - Also, came John DeLoach who was heretofore appointed gdn ad litem for said minors & ---ged the allegations contained in said petition - And appearing to the satisfaction of the Court, that the facts set forth in said Petition are true - It is therefore ordered, adjudged & deemed, that the said Petition be granted - It is further ordered that Gadi Finklea, Dr. R.H. Fanish, J.B. Powell, A. A. Grace & Thos. McCants be & they are hereby appointed commissioners to divide the above described lands equally among the above named joint owners, who are entitled to equal shares in said lands; and that make return to this Court, in writing, & under oath, of their proceedings in this behalf, within sixty days after such partition or division - It is further ordered, that said petition be recorded for future reference.
