This file is copyrighted and contributed by: Ruth Newlan ==================================================================== March 2003 Will of John Powell State of Alabama Monroe Co Septemeber 25th 1834 Be it remembered that I John Powell of the State and County aforesaid being weak of body and infirm in health but of sound mind and --- memory and fully aware of the uncertainty of life and the certaint of Death have thought proper to make and publish this my last will and testament First I desire that when every I may die to be buried in a decent manner and that all my just debts and funeral expenses be paid by my executor hereinafter to be named. And as to property I dispose of it in the following manner. I give to my Daughter Ann Nettles in addition to what she has already received from me the sum of two hundred and fifty dollars. And to my son Elijah I give in addition to what he has hereto before received my sorrel stud horse. And to my son James I give one hundred Dollars in addition to what I have heretofore given him. And to my daughter Elizabeth I give eight hundred Dollars in cash to be paid out of proceeds of my land heretofore sold. And to my daughter ELIZA DAVIS I give one hundred Dollars in addition to what I have before given her. And to my daughter Martha Gates I give two hundred and fifty Dollars in addition to what she has heretofore recieved of me and ten head of stock hogs. And to my daughter Lelouisey? Ann Powell I give her a negro man named Dan and one hundred Dollars and one feather bed. And to my daughter Amelia Powell I give one negro girl named Harriet and one negro girl child named Mary, one feather bed and four hundred Dollars. And to my son John Powell I give one negro boy named Abraham and one boy named Harry. And to my son Pickney Powell I give one negro boy named Jasper and negro boy named Dickson. And to my daughter Louisa Powell I give one negro woman named Sal and her child Ellen one negro man named Jim and a negro girl named Rose. And to my son William Powell I give one negro boy named Gems and one named Stephen and one negro woman named ----. I do hereby appoint my son Elijah Powell my Executor whom I desire to take upon himself the management of his younger brothers and sisters property until my son John attains the age of Eighteen when it is my will and desire that he have a equal share and authority with my son Elijah as Executor. It is my wish that my minor children be all kept together until they are of age or marry which every may first happen. It is my wish that my Executor sahll as soon as convenient into take my minor children to the Choctaw purchase and purchase or enter on the best terms he can Eighty acres of Land in the same and for the benefit of each of my younger sons, John, Pickney and William out of any money either from the sale of my crop or land. It is further my wish that all my stock and household furniture be fore use of my minor children to be used for their maintenance and education and I further request that the sum of four hundred Dollars herein before bequeathed to my daughter Amelia laid out in the purchase of a negro girl. And I further desire that my Executor deliver to my younger children respective their property heretofore bequeathed on their come of age or marrying whichever may happen confiding in the humanity of my Executor to treat my younger children as his brothers and sisters in all things ---- in giving them suitable education.
