Arthur by consent of all parties interested in said Estate, It is ordered that he be & he is hereby appointed administrator of said Estate, he having filed his bond according to law, with Geo H. Gray, Simon R. Gray, Rufus C. Torrey, & James M. Lindsay, as Securities. Mary Dellet, decd } Estate of } Ordered that John C. Arthur as administrator on the Estate of Mary Dellet, decd be & he is hereby authorized to sell all the personal property of said Estate (except negroes) on a credit of twelve months, according to the statute. Mary Dellet, decd } Estate of } It appearing to the satisfaction of the Court that the heirs of Mary Dellet are all of age, & desire a sale fo the real Estate. It is therefore ordered that John C. Arthur, administrator on said Estate be & he is hereby authorized to sell all Real Estate of said decd- on a credit of twelve months. Mary Dellet, decd } Estate of } On the application of John C. Arthur, administrator on the Estate of Mary Dellet decd- It is ordered by the Court that James Daniel, John W. Slaughter, James M. Lindsay, Stephen Steel & George W. Foster be & they are hereby appointed commissioners to divide the balance of the personal property of said Estate consisting of fifteen negroes, equally between Mary C. Arthur wife of John C. Arthur, Leah R. Hayes wife of Charles W. Hays, George H. Gray & Simon Peter Gray & make a report (under oath) of the proceedings to this Court- Court adjourned- M. M. Curry, judge Court of Probate, Special Term, March 1, 1859 Mary Dellet } Estate of }This day came John C. Arthur the admin of said Estate the same having been appointed by a continuance for a final settlement of said estate- Also, came S.P. Gray in person and L.R. Hays by atty, heirs at law of the said decd- And the notice of this settlement having been given as required by the previous order of this Court- and the parties being ready for settlement- And the account being examine & stated - It appears that said admin. has received as cash assetts of the said estate, including cash on hand at the intestate's decease, debts collected and proceeds of sale of real & personal property, with interest thereon, the sum of eight thousand, two hundred & fifty 91/100 Dollars - that he is entitled to credits for cash paid out in payment of debts and expreses of administration in the sum of eight hundred & thirty three 34/100 Dollars- It further appears that he distributes to the heirs on the first day of Sept 1856, the sum of three thousand Dollars, that leaving in his hands to be distributed of this date, the sum of four thousand four hundred & seventeen 57/100 Dollars- ($4417.57) But inasmuch as the said S.P. Gray admitted in open Court that he had released & relinquished to the other heirs all claim upon seven hundred & ten 12/100 Dollars of the said reainder to be distributed- It is, therefore ordered & decreed; that the said sum of four thousand four hundred & seventeen 57/100 Dollars be distributed as follows, to wit: To the said Simon P. Gray, the sum of nine hundred and twenty six 86/100 Dollars- To George H. Gray, the sum of eleven hundred & sixty three 57/100 Dollars- To Chas. W. Hays & Leah R. Hays, for the use of the said Leah R, the sum of eleven hundred & sixty three 57/100 Dollars- and that the said John C. Arthur, as husband & trustee of Mary C. Arthur, be authorized to retain the sum of eleven hundre & sixty three 57/100 Dollars in full of her distrubtive share in said estate:- And the said administrator then in open Court, paid over to the said Simon P. Gray, the full amount of the decree in his favor; to wit: the said sum of nine hundred & twenty six 86/100 Dollars- And it is ordered that the said George H. Gray, and Chas. W. Hays & Leah R. Hays be entitled to Execution to enforce the payment of the amounts herein respectively decreed to them- It is further ordered & decreed that the account current as stated by the Court, be recorded & placed on file- and that the administration of the said estate be held as finally closed.- Court adjourned M.M.Coney, Judge
