I. Kittrell Agee of the County of Monroe and State of Alabama- I give and devise unto my sister Martha Dumas five hundred dollars to be paid or laid out by my Executor for provisions for her in ten years, that is my Executor shall purchase annually for my sister Martha annually, fifty Dollars worth of provisions for ten years - I give and devise unto my half sister Elizabeth A. Agee the --tive balance of my property and effects after the payment of my debts and expenses - I hereby constitute and appoint James M. Agee Executor of this will - It is my will and desire and I so diecr that my Executor (or whomsoever may be appointed administrator with this will annexed) shall have full power and authority to use my interest in the Steam Boat Magnolia as to him may seem most profitable either by selling the same at private or public sale or by retaining said interest until such time as he may think adviseable and then selling at priviate or public sale and the proceeds after paying my debts - to pay as above devised fifty Dollars a year for ten years for provisions for my sister Martha, the balance to be paid over to my sister Eliazabeth A. Leslie on of the subscribing witnesses to the foregoing Instrument who being duly sworn deposeth & saith that N. I. Kittrell Agee signed and sealed said Instrument and acknowledged the same to be his last will & testament on the day & year therein mentioned in the presence of this affiant and in the presence of Wm A. Leslie the other subscribing witnessess, bother of whom signed their names as witnesses thereto at the request & in the presence of said Testator and in the presence of each other, and that the said Testator at the time of executing said will was of sound & dispossing mind & memory.- Sworn and subscribed April 5th A.D. 1854 Ch.
