KNOW ALL MEN BY THESE PRESENTS THAT I, Almon Sanderson of the County of Montgomery and State of Alabama, considering the uncertainty of this life, and being of sound mind and memory, do make, declare and publish this, my last will and testament. 1st. That my dear wife, Elizabeth, one fourth 1/4 of my entire real estate on my plantation where I now live, including my homestead, together with all of my household and kitchen furniture, also all of my farming tools, wagons, plows and gear, also thirty sheep, 1st choice, five cows and calves, 1st choice, three head of horses or mules, 1st choice, also 1 sundown or double buggy, also all the proceeds of my present crop of corn and cotton, after paying the expenses of the same, also all my blacksmith tools, to have and to hold for her own use and behoof during her natural life, then to go to my daughter, Carry Lee, to have and to hold forever. 2nd. To my son, Henry C. Sanderson, I give three acres of land where he is now building a house to live in. 3rd. I then will all of the remaining three-fourths of my real estate to be equally divided between my three sons, Thomas L., Henry C., and James M. Sanderson, to be equally divided between them, each one taking one fourth which is to include my grist mill on Pintlala Creek, which is to be equally divided between them, none of the property or land hereby bequeathed is to include any real estate in Pensacola; all of my stock of cows, hogs, sheep, horses, and mules, not already bequeathed is to be equally divided between my three sons above mentioned. 4th. My lots and town property in Pensacola, Florida, shall be equally divided between my three daughters, Fanny H. Cogburn, Susan V. Tankersley, and Eliza L. Sanderson. I also will and direct my three sons, Thos. L., H. C., & Jas. M., to pay to my three daughters, six hundred dollars in three equal installments, one third as soon as they get in possession of the property bequeathed, that is sixty-six and two-thirds to each one of them as soon as they become in possession of the property, the same number of dollars one year thereafter and the other two hundred dollars one year after making three payments of two hundred dollars each, the daughters above alluded to are Fanny H., Susan V., and Eliza L., and I also give and bequeath to my granddaughter Permelia A. Moon five dollars to be paid in cash, then all property that has not been hereby disposed of to be equally divided between my wife Elizabeth and my three sons, Thos. L., Henry C., and James M. Sanderson. 5th. I do nominate and appoint my three sons, Thos. L. Sanderson, Henry C. Sanderson, and James M. Sanderson, as my Executors of this my last will and testament. Supple THE STATE OF ALABAMA} In the matter of the Probate of the Last MONTGOMERY COUNTY } Will and Testament of Almon Sanderson, PROBATE COURT } Deceased. Before me, Charles W. Buckley, Judge of Probate Court in and for the County and State aforesaid, personally appeared in open Court John J. Moseley and J. C. Supple who having been by me first duly sworn and examined, did and do depose and say that they are subscribing witnesses to the foregoing instrument of writing, now shown to the said affiants, and which purports to be the last will and testament of Almon Sanderson deceased, late an inhabitant of this County, that the said Almon Sanderson since deceased, signed and executed said instrument on the day the same bears date, and declared the same to be his last will and testament, and that affiants set their signatures thereto, on the day the same bears date, as such subscribing witnesses to the same, in the presence of said testator and at his request, and in the presence of each other, and that said testator was of sound mind and disposing memory and understanding, and, in the opinion of affiants, fully capable of making his said will at the time the same was so made as aforesaid. And deponents further stated that said testator was, on the day of the date of said will, of the full age of twenty one years and upward, and a resident of this County. John J. Mosely J. C. Buckley, Judge of the Probate Court in and for the County and State aforesaid, do hereby certify that the within instrument of writing has this day in said Court and before me as the Judge thereof, been duly proven by the testimony of John J. Mosely and J. C. Supple, subscribing witnesses, to be the genuine last will and testament of Almon Sanderson, deceased, and that said will, together with the proof thereof, has been recorded in my office in Book No. 5 of Wills, at page 358.
