Westcott The State of Alabama} Montgomery Co. } In the name of God Amen: I Samuel T. Westcott of the County and State above written being of sound body and mind but having due regard to the uncertainty of life and the necessity of preparing for death do make and publish this as my last will and testament hereby revoking all former wills by me at any time made. In the first place after my death I wish my body decently buried and that all my debts shall be paid by my executor. 2nd. Inasmuch as I and my brother Wm. B. Westcott are engaged in planting and have bought some land from Samuel Murrell which has not been fully paid for I will direct that our planting interests shall be carried on jointly as heretofore until the debts for these lands shall be fully paid and for this purpose my executor shall have all power necessary and proper so fully as I have if I were living. 3rd. I will and direct that my executor shall keep together all my property even after the debt for the land shall be paid and work and manage the same with the same power that I would have if living, until my children arrive at the age of twenty-one years, or until my beloved wife should marry again, and all the profits there arriving shall be invested in such property as my executor may think proper. Should my wife marry again, then in that event, I will & direct that she shall have her share of the estate, she taking in money or property an equal share with each one of my children. My intention is that when my children shall arrive at the age of twenty one years, then I direct that his share be set off and paid to him and soon as each shall arrive of age. In the meantime, I will that my property shall be kept together by my executor, giving off to each child his share when he arrives at age and the same property shall be managed and conducted, sold and other property bought as fully and completely as I could if I were living and for this purpose and for the purpose of division my executor shall have full power to sell any portion of my estate or all for cash or credit at private or public sale. 4th. I will and direct that so long as my wife and children remain together on my place, my wife being unmarried, she and the children shall be supported and maintained according to such condition in life and I especially will and direct that my children shall be well educated out of my estate. 5th. I hereby appoint my brother William R. Westcott the sole executor of this my will and testament, in witness of all of which I have hereunto set my hand and seal this the seventeenth day of August in the year of our Lord one thousand eight hundred fifty three.
